VAT69 deaths linked to Hassan

Number in intercepted phone conversation belonged to cop’s son, court told. Justice P. Ravinthran fixed July 4 to hear submissions from the prosecution and defence.

KOTA KINABALU - The trial of a special branch policeman Corporal Hassan Basari was told that the deaths of two police VAT69 commandos in a shootout with Sulu gunmen intruders on March 1 was somehow linked with his actions.

The High Court heard on Friday Lahad Datu police Criminal Investigation Department chief ASP Ang Seow Aun indicate as such when disagreeing with an assertion of lawyer Ram Singh.

Ram, the counsel for Hassan had asserted that the deaths of Inspector Zulkifli Mamat and Corporal Sabaruddin Daud had nothing to do with his client.

Hassan, 58, was charged under Section 130M of the Penal Code for withholding information relating to the Sulu intrusion at Kampung Tanduo and allegedly committed the offence at the office at the Lahad Datu special branch on the district police headquarters between January and March 3, 2013.

He faces up to seven years imprisonment or fine or both upon conviction.

Ram also asserted that he (Ang) was not able to carry out a full probe into the intrusion and the allegations against Hassan due to provisions under Security Offences (Special Measures) Act 2012 to which Ang disagreed.

Ang also told the High Court that one of the numbers in a telephone conversation intercepted by police belonged to the son of Hassan.

He said the number 0138888359 was registered under the name Mohd Esham Hassan.

“Based on my investigation, the owner of the number is the accused’s son,” he said.

Meanwhile, Deputy Public Prosecutor Datuk Mohd Hanafiah Zakaria told the court he received an application from Supt Anwar Ahmad of the Special Branch headquarters in Bukit Aman to intercept the telephone conversations of a policeman on Feb 15.

He said the communication interception was needed to obtain security information and to establish the accused’s relationship with the Kampung Tanduo intruders.

The prosecution closed its case after producing 18 witnesses.

Justice P. Ravinthran fixed July 4 to hear submissions from the prosecution and defence.
