Sabah RCI: At least one forged IC found every two weeks

KOTA KINABALU - The Sabah National Registration Department discovers at least one forged identity card every two weeks.

Its director, Ismail Ahmad, told the royal commission of inquiry (RCI) on illegal immigrants in Sabah identity card forgery is widespread in the state.

“I don’t remember the exact numbers, but almost every two weeks there will be cases of people being caught with forged identity cards,” he said at the Kota Kinabalu court complex.

However, Ismail said, it is impossible to illegally obtain a genuine identity card now.

“I guarantee that there is no way it can happen, the work is all computerised now,” he said.

He said all blue identity card applicants must have birth certificates to prove their citizenship.

Ismail told the RCI the state’s problems with genuine identity cards began in 1978, when genuine blue identity cards were illegally obtained from the NRD.

He said other than birth certificates, the NRD also accepted statutory declarations as a valid document of evidence that the applicant was born in Sabah.

He noted that at that time many Sabahans in the interior areas did not have birth certificates.

“So we accepted declarations signed by village heads and verified by the district officer.

However, the practice was stopped in 1987 when it was discovered there was abuse of power.

Ismail told the RCI that blue identity cards with expiry dates on them being circulated on the Internet were in fact green cards or temporary residence cards.

He told the RCI that for a time, the colour of the MyKad was the same blue.

“But all the cards had markers on them to indicate the type of card they were,” he said.

However, Ismail said, this caused confusion and the department made the temporary residence card green, the permanent resident card red and blue was only for citizens. – Malaysian Insider

  4. UPKO, PBS and PBRS are the three main BN parties representing the KadazanDusunMurut community in Sabah. The proposal for every MyKad issued in Sabah so far to be returned to the relevant authorities and new MyKads be issued to Sabahans, will be put forward to the royal commission of inquiry (RCI) on the illegal immigrants in Sabah, said Dompok, who is also the plantation industry and commodities minister.

I feel that the only way is to collect all these identity cards and give fresh cards so that it can be settled once and for all who exactly is the citizen of this country and who are eligible to become the natives of Sabah.

I did also suggest that all the parties in Sabah can get together to put up proposals for the federal cabinet to discuss and decide what is there to be done. My proposal is to review all the identity cards that were issued in Sabah, and there is no other way to do this other than to give everybody a fresh card,” he was quoted as saying by the daily.

Dompok also suggested that future applications for citizenship must be made known to the public. “It must first be like the banns of marriage; it must be advertised for objection before citizenship is granted. There must be a specific time (for objection) because a vast majority of people in this country do not even know that there have been cards issued, and all of a sudden, Malaysian citizens pop out from nowhere and claim their rights to the country.”

  9. Pairin, who is also Sabah deputy chief minister, said there were many unclear issues about the state’s statistics as there were many illegal immigrants who did not have documents, had fake documents or had obtained genuine ones through dubious means.

    KOTA KINABALU, June 20 (Bernama) -- Sabah must practise self-help to address the pressing issue of illegals in Sabah, former Sabah chief minister Datuk Yong Teck Lee told the Royal Commission of Inquiry (RCI) on illegal immigrants in Sabah today.

    He said the current situation in Sabah was already at a critical stage and urgently needed a solution.

  16. Yong, who is Sabah Progressive Party (SAPP) president, said the state government could issue Sabah identity cards (ICs) to genuine Malaysians in the state.

    "Sabah may pass a new ordinance, at the state assembly sitting, to issue the Sabah ICs to original Sabahans and their descendants who were in North Borneo or now Sabah on Aug 31, 1963 and became automatic citizens under the terms of the Malaysia Agreement.

    "All other Malaysians have to apply to become Sabahans. Kuala Lumpur has no power to grant Sabahans status," he elaborated.

  17. According to Yong, Sabah needed a State Registration Ordinance to establish a framework and form a state registration department which would deal with the issuance of the proposed Sabah IC.

    However, he stressed that the Sabah IC was not a new citizenship document, but rather an identification document for use in the state such as for immigration, land, state civil service, licensing and other state government purposes.

  18. Yong told the inquiry that the presence of illegal immigrants in Sabah was contributed by the migration of people from poor provinces in neighbouring countries resulting in a 'push factor', driving the immigrants out of their native countries to seek economic improvement.

    He noted that when the Brunei, Indonesia, Malaysia and Philippines East Asean Growth Area (BIMP-EAGA) was established to implement regional peace and prosperity, there was a reverse flow of immigrants returning to their native land due to the economic prosperity back home.

  19. "In the case of Sabah, there are many 'ex-Malaysians' who have returned to Mindanao and Kalimantan.

    "I came across Malay-speaking 'ex-Malaysians' when I visited Kalimantan and they told me that they had returned home as Kalimantan had opened up one million hectares of oil palm plantation which attracted many Indonesians to return from Sabah and the workers did not have to pay levy and face harassment from Malaysian authorities," he said.

  20. Unlike Kalimantan, Yong said the BIMP-EAGA had not fully addressed the situation plaguing Malaysia, Indonesia and the Philippines.

    "If the BIMP-EAGA's regularisation programme had been successfully followed up, the illegal immigrant problem in Sabah would have been mitigated to a large extent," he added.

  21. SAPP vice-president Datuk Eric Majimbun said the issue of foreigners with forged ICs would not only impact the electoral roll, but would also lead to social implications.

    He told the inquiry that he also faced a problem in which a Filipino man obtained a fake IC under the name of Jerome Majimbun.

  22. Conducting officer Datuk Azmi Ariffin revealed that the name Jerome Majimbun with an IC number 560930-12-5739 and an old IC number H 0540992 were not registered with the National Registration Department, nor did the numbers appear in the electoral roll.

    "This man (Jerome) was using my father's name. What if he committed a crime? It will affect my family's name," Majimbun argued.

    The inquiry is led by former chief judge of Sabah and Sarawak Tan Sri Steve Shim Lip Kiong.

    Also on the panel are former Universiti Malaysia Sabah vice-chancellor Datuk Dr Kamaruzzaman Ampon, former Kuala Lumpur police chief Datuk Henry Chin Poy Wu, former Sabah state secretary Datuk KY Mustapha and former deputy chief minister Tan Sri Herman J Luping, who is also former state attorney-general.

  23. Kesediaan pendatang tanpa izin membayar sebarang amaun untuk mendapatkan kad pengenalan (IC) Malaysia telah membawa kepada kewujudan sindiket pemalsuan IC di Sabah, Suruhanjaya Siasatan Diraja (RCI) yang menyiasat isu pendatang tanpa izin di Sabah, diberitahu Iisnin.

    Panel Inkuiri Suruhanjaya Siasatan Diraja (RCI) berkenaan pendatang haram di Sabah hari ini dicadangkan supaya menarik semula kesemua kad pengenalan yang telah dikeluarkan kepada pendatang asing, kata ahli Parlimen Barisan Nasional (BN) Datuk Wilfred Madius Tangau.

  24. Pensyarah kanan Sosial Sains Universiti Malaysia Sabah (UMS) Dr Dayang Suria Mulia berkata memperoleh IC merupakan strategi pendatang tanpa izin untuk kelangsungan hidup di Sabah dan mereka bersedia membayar harga tinggi untuknya.

    Ahli Parlimen Tuaran yang juga saksi ke 117 dipanggil untuk RCI berkata kepada panel yang diketuai bekas Hakim Besar Sabah dan Sarawak Tan Sri Steve Shim Lip Kiong, masalah pemberian kad pengenalan kepada pendatang asing juga tidak akan pernah selesai, melainkan rombakan keseluruhan sistem pemberian kad pengenalan dilaksanakan.

  26. Dayang Suria juga berkata pendatang tanpa izin mempunyai saudara-mara di Sabah yang memudahkan mereka untuk datang ke sini.

    Beliau kemudiannya mencadangkan agar mereka yang telah diambil kad pengenalannya dalam proses tersebut untuk memohon kembali menggunakan sijil kelahiran.

  27. Beliau menjelaskan saudara-mara berkenaan akan membantu menjamin keselamatan mereka apabila mereka masuk ke negeri ini menerusi saluran tidak sah.

    “Jika kita tidak melakukan perkara itu, bagaimana kita mahu menyelesaikan masalah kad pengenalan meragukan seperti ini,” soalnya lagi, dan menambah kes pemberian kad pengenalan meragukan itu tidak akan pernah berhenti, sebaliknya akan berterusan.

  28. Dayang Suria berkata dalam kajiannya mengenai pendatang yang tidak mempunyai dokumen pada 1999, beliau mendapati mereka yang tidak mempunyai dokumen berpendapat ia memberi kebebasan untuk mereka bertukar kerja.

    “Pada mereka yang rasa mereka benar-benar warganegara, tiada apa nak ditakutkan,” tambahnya yang juga merupakan saksi pertama dalam kalangan ahli politik yang dipanggil memberi keterangan kepada RCI.

  29. Katanya jika seorang pekerja asing mempunyai permit untuk bekerja dalam sektor perladangan, sekiranya dia mahu tukar ke sektor lain, dia perlu memohon permit kerja yang baharu.

    UPKO jelas Wilfred telah melakukan kaji selidik bagi menyiasat kegiatan pemberian kad pengenalan kepada warga asing sebaik sahaja RCI dibentuk, dan mendapati pemberian kerakyatan kepada warganegara asing berkenaan bukan setakat berlaku pada 1980an, tetapi juga awal tahun 90an.

  30. "Apa yang saya dapati menarik (dalam kajian itu), tidak mengira betapa ketatnya undang-undang ke atas mereka, terdapat mereka yang tidak bimbang, terdapat mereka yang tidak takut (kepada undang-undang). Sesetengahnya memilih untuk tidak mempunyai dokumen," katanya.

  31. Dayang Suria juga menegaskan industri-industri di Sabah, khususnya dalam sektor perladangan dan pembuatan, amat bergantung kepada bekalan pekerja asing.

    “Manakala 90 peratus daripada mereka membeli kad pengenalan tersebut,” katanya, dan menerangkan laporan kaji selidik tersebut akan didedahkan oleh Presiden UPKO Tan Sri Bernard Giluk Dompok pada Jumaat ini kepada RCI.

  32. Beliau menjelaskan atas hakikat bahawa penduduk tempatan tidak bersedia menjadi buruh kasar, majikan terpaksa bergantung kepada agensi penyumberan luar bagi memenuhi keperluan mereka.

    RCI sebelum ini pada Mei diberitahu Sabah mengeluarkan kad pengenalan 12 kali lebih banyak berbanding Sarawak, dengan sekitar 66,000 pendatang haram di negeri Borneo tersebut telah diberi kad pengenalan biru sejak 1963.

  33. Sementara itu, anggota Dewan Perniagaan dan Perindustrian India Muslim Sabah (DPPIMS) Mohd Ansar Maidin menafikan dakwaan dalam sebuah blog tahun lepas bahawa DPPIMS terlibat dalam mendapatkan kewarganegaraan Malaysia untuk pendatang tanpa izin.


    Beribu pelarian Filipina melarikan diri ke Sabah pada tahun 1970-an untuk menyelamatkan diri daripada perang saudara Sulu di selatan.

    Sempadan laut Sabah juga telah diceroboh pada Februari lalu apabila sekumpulan lelaki bersenjata daripada Sulu menyerang Lahad Datu yang terletak di pantai timur negeri tersebut, dimana masuk disana kurang satu jam menerusi bot dari selatan Filipina. Sarawak, bagaimanapun, bersempadan dengan wilayah Kalimantan, Indonesia.

  34. Beliau berkata anggota DPPIMS sentiasa memastikan mendapatkan permit kerja untuk pekerja asing mereka, dan tidak membantu mereka mendapatkan kewarganegaraan.

    Kira-kira 28 peratus daripada 3.2 juta penduduk yang besar di Sabah adalah warga asing, sejumlah besar 889,000 orang.

    Kemasukan pendatang asing tanpa izin telah menimbulkan kemarahan masyarakat pribumi Sabah seperti Kadazandusun dan Murut (KDM), ramai daripada mereka merasakan kedaulatan negeri Borneo tersebut telah dirompak ekoran kebanjiran warga asing dari Filipina dan Indonesia.

Anggota panel juga terdiri daripada bekas Naib Canselor UMS Datuk Dr Kamaruzzaman Ampon, bekas Ketua Polis Kuala Lumpur Datuk Henry Chin Poy Wu, bekas Setiausaha Kerajaan Negeri Sabah Datuk KY Mustapha dan bekas Timbalan Ketua Menteri Sabah Tan Sri Herman J Luping, yang juga bekas Peguam Besar negeri.

    Bernard Dompok tewas di kerusi Parlimen Penampang, kawasan majoriti KDM, pada pilihan raya 5 Mei baru-baru ini.

    Beberapa warga asing Pakistan dan India juga pernah memberi keterangan di RCI bagaimana mereka mendapat kad pengenalan biru dalam tempoh beberapa tahun selepas tiba di Sabah dan kemudiaannya mengundi dalam pilihan raya.
