Musa involved in IC scam?


The disclosures in the current RCI hearing in Sabah may lead to more damaging testimonies implicating the state's top leadership.

KOTA KINABALU: Sabah Chief Minister Musa Aman, who is also the state’s Umno chief, could be in for some uncomfortable moments soon as those involved in handing out Malaysian documents to illegal immigrants in Sabah continue to expose the high and mighty.

So far, one ex-chief minister, Osu Sukam has been implicated by the testimony of a former director of Sabah’s National Registration Department (NRD) at the ongoing investigation by Royal Commission of Inquiry (RCI) on illegal immigrants problems in Sabah here.

Ramli Kamaruddin, in his testimony said Osu was present with then federal deputy home minister Megat Junid Megat Ayob at a hotel here in 1994 when he was given instruction “to issue NRD receipts using the name and identity card numbers of voters already in the electoral roll, with the sole purpose of allowing them to vote to help ensure that a state government endorsed by the federal government would win” in Sabah.

A former right-hand man of ex-premier Dr Mahathir Mohamad, Abdul Aziz Shamsudin, was also mentioned at the RCI hearing which, going on current disclosures, promises to expose one of the biggest scandals in Malaysia’s history involving members of the ruling Umno-led Barisan Nasional (BN) coalition government.

Another former chief minister, Harris Salleh, who testified before the five-member RCI, tried to shield himself from the scandal by saying that it was the federal authorities that gave immigrants Malaysian documents like IC, and not him or even the state government he led.

He also denied any knowledge of a project to parcel out ICs in exchange for votes.

Musa was dragged into the scandal after his name was mentioned many times in books by blogger Mutalib M.D.

The blogger had implied Musa’s involvement in recruiting illegal immigrants in Sabah to become Umno operatives and also voters to defeat Parti Bersatu Sabah (PBS) state government in the 1994 election.

Mutalib, who did his own research and interviews with people directly involved in or in the know of the security scandal, has written prolifically on the hiring of Muslim illegal immigrants from the Philippines and Indonesia by Umno.

Musa’s involvement is based on his being the chairman of an alleged special task force set up by Sabah Umno to recruit immigrants. A former Umno member, Jabar Khan Napi, has also repeatedly named Musa in the scam.

Jabar Khan, known for his outspokenness, is to give his own testimony to the RCI soon and his could be explosive and could severely damage Musa’s standing among Sabahans especially his Kadazandusun allies within the state BN.

However, Jabar Khan’s name in the RCI witness investigation list is stated as “reserve witness”.

So far several former Sabah NRD officers, including one Yakup Damsah, have testified that he and other officers stayed at the residence of Abdul Aziz in Kg Pandan, Kuala Lumpur, where they ran an operation to issue blue identity cards to immigrants in Sabah.

Yakup, who was then Tamparuli NRD chief, told the RCI that he and the other NRD officers were flown from Sabah to Kuala Lumpur, and were tasked to sign the identity cards that were to be issued to the immigrants, which were then laminated at the NRD headquarters in Petaling Jaya and shipped to the Kota Kinabalu NRD for distribution.

He said prior to that they received instructions from then-Sabah NRD chief, Abdul Rauf Sani, about their special assignment to issue blue identity cards to immigrants.

Yakup, who was eventually detained under the Internal Security Act (ISA), said his group signed a total of 40,000 blue identity cards within a month, based on the filled up application forms provided to them.

The RCI is chaired by former judge Steve Shim and is convening daily inquiry for the next few weeks at the old wing of the Kota Kinabalu High Court Building.

    3. Macammana pula Datuk Musa boleh terlibat dalam hal ini. Sedangkan kes ini berlaku sebelum beliau lagi. Jadi nampak sangat ada pihak yang cuba mengaitkan beliau.

    5. Tun Mahathir sendiri telah mengatakan yang mana betul ada pemberian mykad kepada warga asing. Tapi yang perlu kita tahu mengikut syarat-syarat yang ditetapkan dalam undang-undang yang sedia ada.

    Penubuhan Suruhanjaya Siasatan Di Raja (RCI) bukan sahaja membuktikan komitmen kerajaan Barisan Nasional (BN) untuk memperjuangkan hak dan kesejahteraan rakyat Sabah, malah penubuhannya juga merupakan satu petunjuk bahawa kerajaan pimpinan Datuk Seri Najib bersedia untuk berhadapan dengan desakan, tuntutan atau apa sahaja masalah di Sabah yang perlu diambil perhatian.

    RCI bukanlah kaedah pertama atau terakhir yang dilaksanakan oleh kerajaan dalam menyelesaikan masalah pendatang haram dan juga Projek IC di Sabah. Sebelum ini juga, kerajaan telah melaksanakan pelbagai usaha termasuklah penubuhan Jawatankuasa Pusat dan juga Negeri bagi menyiasat dan merangka penyelesaian kepada fenomena warga asing di negeri ini, penubuhan Program 5P disamping penguatkuasaan berteruskan dari anggota beruniform samada di daratan mahupun perairan. Pendek kata, pelbagai usaha telah dan sedang dilaksanakan, namun masalah ini tetap berterusan.

Jika ada pihak yang mengatakan bahawa kerajaan tidak ikhlas menyelesaikan masalah ini hanya kerana kerajaan mengumumkan RCI disaat-saat akhir, ternyata andaian itu tidak benar sama-sekali memandangkan perkembangan siasatan setakat ini membuktikan badan itu benar-benar bersifat neutral tanpa memihak kepada mana-mana pihak sehingga ada kalanya membuka ruang kepada pihak pembangkang untuk memanfaatkan apa sahaja butiran siasatan untuk dipolitikkan.

    Menurut kenyataan Pengarah Pasukan Petugas Khas Persekutuan untuk Sabah dan Labuan, Datuk Suhaimi bin Mohd Salleh, kerajaan telah mengusir 446,173 pendatang tanpa dokumen ke negara asal mereka sejak 1990.

    1. Angka tersebut adalah termasuk pelarian yang tidak mempunyai dokumen yang sah. Beliau turut memaklumkan bahawa skop kerja Pasukan Petugas Khas adalah untuk menangani isu berkaitan pendatang asing dan mengenal pasti pelarian dan pendatang yang merangkumi pelarian Filipina dari Filipina Selatan, pendatang asing tanpa izin yang memasuki Sabah dan Labuan, dan buruh asing dari Indonesia.

    1. Namun kewujudan beberapa sindiket pemalsuan IC serta sindiket membawa masuk warga asing ke negeri ini menyukarkan lagi usaha-usaha kerajaan.     Tahun lepas saja, negara telah dikejutkan apabila Jabatan Siasatan Jenayah Komersil (JSJK) IPD Tawau berjaya membongkar kegiatan sindiket ‘IC Palsu’ yang disyaki didalangi oleh seorang pegawai Jabatan Pendaftaran Negara (JPN) dan bergiat aktif di sekitar Pantai Timur negeri ini.

    1. Modus operandi sindiket ini dipercaya berorientasikan penawaran dokumen berbentuk MyKad asli dan meminta mangsa-mangsa mereka supaya menyerahkan duit di antara RM1,000 – RM5,000, gambar, sijil lahir (jika ada) dan cap jari.

    Kes seperti ini bukan yang pertama dan terakhir, malah besar kemungkinan masih banyak lagi sindiket yang belum diberkas samada bergerak secara berpasukan mahupun secara individu. Keuntungan lumayan sentiasa mendorong pihak-pihak yang tidak bertanggungjawab melakukan apa sahaja aktiviti haram walaupun mereka sedar tindakan itu membawa kepada hukuman yang berat.

Dakwaan kononnya mangsa pelarian ini dibantu pihak tertentu untuk mendapatkan IC juga tidak benar apabila beberapa pelarian Filipina yang memberi keterangan di hadapan Suruhanjaya Siasatan Diraja (RCI) bagi menyiasat masalah pendatang tanpa izin di negeri Sabah hari ini memberitahu bahawa tiada mana-mana pihak yang membantu mereka bagi mendapatkan kad pengenalan (IC). Salah seorang daripada mereka, Abd Salam Ali, yang datang ke Sabah pada 19 Januari 1971 berkata, beliau sendiri yang berusaha mendapatkan IC nya itu.

  32. berkenaan dengan mangsa pelarian perang di selatan Filipina sekitar tahun 1970an. Kerajaan mengambil peranan murni dan prihatin melibatkan aspek kemanusiaan untuk membantu pelarian dan mangsa perang. Tindakan kerajaan telah mendapat kerjasama dan diperakui oleh badan antarabangsa seperti UNHCR.

  33. Fenomena pemberian IC kepada warga asing ini sebenarnya konsisten dengan penjelasan Bekas Perdana Menteri Tun Dr Mahathir ketika mengulas mengenai dakwaan bekas Pengarah JPN Sabah, Ramli Kamarudin bahawa kerajaan pada ketika itu terlibat memberikan kad pengenalan kepada pendatang asing.

  34. Beliau menegaskan bahawa semua kelulusan berhubung pemberian kerakyatan tersebut dibuat berdasarkan peruntukan undang-undang. Tambah beliau, Malaysia sentiasa menerima orang asing untuk menjadi warga negara sekiranya mereka memenuhi syarat-syarat tertentu.

  37. Tetapi mereka lupa bahawa dalam undang-undang Malaysia ada diperuntukkan pemberian kerakyatan kepada pihak-pihak yang berkelayakan. Jesteru, jika Pembangkang tidak bersetuju dengan pemberian kewarganegaraan kepada warga asing ini, mungkin selepas ini mereka boleh masukkan agenda "penghapusan sebarang undang-undang berkaitan kewarganegaraan" ini dalam manifesto pilihanraya mereka.

  38. Penghapusan undang-undang ini juga konsisten dengan janji Anwar Ibrahim yang mahu menghapuskan semua undang-undang "lapuk" di negara ini jika PR diberikan mandat memerintah. Dengan ini sama-samalah kita lihat bagaimana penerimaan rakyat terhadap kepimpinan Anwar Ibrahim yang sanggup melakukan apa sahaja asalkan dia dapat mempertahankan kuasanya.

Pembangkang cuba untuk terus menjatuhkan Musa Aman dengan isu RCI ini dengan harapan supaya rakyat akan terus hilang kepercayaan kepada beliau. tp, pembangkang harus ingat bahwa orang-orang sekarang sudah bijak. tidak seperti dahulu. orang sekarang tidk lagi terpengaruh dengan dakwa mulut semata-mata tetepi lebih kepada tindakan pemimpin/ parti itu sendiri. Pembangkang habis-habisan untuk menyalahkan kerajaan negeri berkenaan dengan isu rci ini sedangkan ianya bukan pada takluk kerajaan negeri semata-mata melainkan kerajaan persekutuan.

    Beliau berkata, bakal calon BN bagi kesemua 222 kerusi Parlimen dan 505 kerusi Dewan Undangan Negeri (Dun) telah melalui proses saringan teliti termasuk Polis Diraja Malaysia (PDRM), Suruhanjaya Pencegahan Rasuah Malaysia (SPRM) dan Jabatan Insolvensi untuk memastikan calon tersebut ‘bersih’ dan bebas masalah.

    Baru-baru ini, Pengerusi Panel Perundingan dan Pencegahan Rasuah SPRM Datuk Johan Jaaffar mencadangkan semua parti politik menghantar senarai calon yang akan bertanding dalam PRU Ke-13 untuk ditapis SPRM.

    Cadangan itu adalah untuk memastikan calon-calon yang bakal bertanding 'bersih' daripada rasuah selain mengelak sebarang tohmahan tidak berasas ke atas mana-mana individu atau parti di belakang calon itu.

    Pada majlis yang sama, Tengku Adnan yang juga Anggota Parlimen Putrajaya berkata beliau dan Perbadanan Putrajaya (PPj) akan terus menggemblengkan tenaga untuk menyediakan keperluan bagi memberikan keselesaan kepada penduduk.

    SENJATA Pembangkang adalah fitnah dan kemudian membuat janji retorik. Bagi pembangkang tiada yang betul di mata mereka, apapun kerajaan buat.

    Strategi pembangkang adalah untuk tembus ke dalam akar umbi penyokong dan ahli umno dengan menabur berbagai fitnah, agar supaya rakyat bergaduh dan curiga antara satu sama lain.

    Disebabkan strategi pembangkang adalah untuk melemahkan parti di peringkat akar umbi, maka untuk mengelak agar rakyat tidak termakan tipu helah mereka, Ketua Menteri Sabah, Datuk Seri Musa Haji Aman, merangkap Pengerusi Badan Perhubungan Umno Negeri meminta rakyat terutama ahli-ahli Umno supaya memperkemaskan jentera parti termasuk mengenal pasti kelemahan khususnya di peringkat akar umbi.

    Tambahnya, ia penting bagi membolehkan kekuatan parti tidak akan mudah dibolosi apatah lagi pembangkang kini berusaha menggugat BN dengan melempar dakyah-dakyah yang tidak berasas.

  124. Well Dr Mahathir always has the knack for speaking volumes in the least amount of words. In a conversation once with Dr Mahathir, we told him about the criticism - current at that time - that all his spending on the Penang Bridge, the N-S Highway, Putrajaya, the KLIA and other "mega" projects at that time had been a drain on the Malaysian economy. We were referring to a book written by an Indian guy with a PhD who was named after an African. It was a tiring and long winded argument.

  128. This is not unlike the 30,000 to 50,000 Indians who have been given citizenship on the Peninsula in recent years. Many of the Indians have had their citizenship applications approved. There are also many Indians who never applied for citizenship (due to factors like illiteracy and not being able to speak a word of Malay) and they have been assisted by some NGOs to get their citizenship applications processed. So even those who did not apply for citizenship on their own are being processed for citizenship.

  130. In Yahoo Malaysia today an ex Filipino refugee Ismail Balaka claims he was granted citizenship circa 1975 (?) without going to the National Registration Department.

  131. Then in the same breath Ismail Balaka says that he did go to the village hall where officers from the National Registration Department were present. He signed an application form, gave his fingerprints and had his photograph taken. This was surely part of the process for getting his citizenship. And he received his Malaysian IC five months later. (One would assume that if there was forgery going on, why not issue the Malaysian ICs on the spot !)
    Another ex-refugee Hatta Ghani said he applied for citizenship in 1988 but it was granted to him in 1990.

  133. If we wanted to create instant citizens there is a much easier solution - just give citizenships to the two million Indons that are floating around the country. The vast majority of Indons do not even have PR status here. Our construction foreman Adi who has been here for 16 years and has a regular job with a monthly salary of RM5000 only has a PR.
