Reject and Revoke Unlawful Tourism Tax – Dr. Jeffrey

KOTA KINABALU - “If Malaysia is to survive, there is only but one solution to the tourism tax debacle, that is, to reject and revoke the federalizing of “Tourism” in the Federal List in the Federal Constitution and the subsequent imposition of the tourism tax,”  said Datuk Dr. Jeffrey Kitingan, president of Parti Solidariti Tanah Airku (STAR) cum Bingkor Assemblyperson, in response to the on-going spat on sharing of the tourism tax.

“Any another solution would only mean impeaching on the sacrosanctity of the Federal Constitution being the supreme law of the land and meaning that the Federation of Malaysia is dead and buried” added Dr. Jeffrey.

The key to the solution is the revocation of the unconstitutional addition of “Tourism” as Item 25A of the Federal List in 1994 and breaching the basis of Malaysia being a federation of equal partners as set out in the Cobbold Commission, IGC Report and the agreement reached between Britain and the Malayan government in November 1961 that Malaysia would be a new federation embracing Malaya, Sabah, Sarawak and Singapore.

By adding Item 25A and usurping the residual powers of Sabah and Sarawak, the federal government has over-stepped their boundary and dishonouring the basis of the formation of Malaysia as a federation.

If the federal government insists on collecting the tourism tax, the federal government is bullying the Sabah and Sarawak governments. And if the State governments of Sabah and Sarawak agree to share the tourism tax, whether 10% as proposed by the federal government despite its earlier promise to share equally, or equally as insisted by Sabah and Sarawak, they are subserviently kowtowing to Kuala Lumpur.

Whichever way, by accepting and agreeing the tourism tax, all those involved are part of the conspiracy to trample on the sanctity of the Federal Constitution and its lawful constitutional process.

No matter how desperate the Federal Tourism Ministry or the federal government is short of funds to pay the debts of the Ministry, or the weak attempt by the Sabah government to now demand for its 1/3rd share of the tourism tax, it only mean one thing for the voters to remember in PRU-14.

“That the federal and Sabah governments do not have the honesty and integrity to uphold the Federal Constitution and the rule of law and do not respect Sabah as an equal partner in the Federation of Malaysia, and they should be rejected and voted out in the coming PRU-14”.

It also means that Sabah and Sabahans have a bleak future if the Sabah BN government continue to form the next Sabah government as they are spineless and unable to protect Sabah.

“A STAR/Gabungan Sabah-led Sabah government will definitely stand up to the Federal government and protect the rights and interests of Sabah as an equal partner and uphold the Federal Constitution. Its leaders will not be made up of buffaloes led by the nose,” added Dr. Jeffrey.
