Swiss govt ready to freeze Musa’s accounts

KUALA LUMPUR: The Swiss government has indicated its “readiness” to freeze the “illicit assets” of politically exposed Malaysian leaders if Malaysia submits legal assistance requests to its government.

According to Switzerland, the nation’s federal constitution empowers the Swiss government (known as the Federal Council) to freeze assets of politically exposed persons in Switzerland.

“Such a freeze usually happens with a view to entering into legal-assistance relations with the countries of origin,” it said in an official statement which was released by a Swiss-based NGO Bruno Manser Fund (BMF) today.

The statement came days after the announcement by Switzerland’s Attorney-General that it had opened a criminal case against Swiss bank UBS on grounds of the bank’s suspected laundering of US$90 million on behalf of Sabah Chief Minister Musa Aman.

The statement was a written response to questions submitted last May by Swiss social democrat MP, Carlo Sommaruga.

In the official reply, the Swiss Federal Council declared its readiness to freeze illicit assets of politically exposed persons from Malaysia, namely Musa and Sarawak Chief Minister Taib Mahmud.

Both Musa and Taib have been accused of amassing unexplainable amount of wealth while helming their respective states. Of the two, Taib allegedly has a worse track record which BMF and online investigative portal Sarawak Report have actively exposed.

But in declaring its willingness to act, the Swiss government noted that this could only happen if Malaysia were to submit legal-assistance requests to Switzerland.

“Switzerland has hitherto not been requested by Malaysia to provide legal assistance.

“Should such a request come from Malaysia, then Switzerland would provide the legal assistance if the legal prerequisites are met and if there are no grounds for exclusion. The request would have to be first examined by the Federal Office of Justice.

“At the moment, such a situation does not exist in the case of Malaysia,” the official statement said.

Swiss-aided HK probe

Musa and his UBS accounts have been the focus of parallel investigations in Singapore, Malaysia, Hong Kong and Switzerland for alleged money laundering running into hundreds of millions dollars.

The investigations have taken its toll on UBS’s other alliances.

Sarawak Report had in July reported that HSBC’s global head of compliance had resigned in disgrace, acknowledging the bank had turned a blind eye to the staggering S$38 trillion of suspect transactions.

The issue has also apparently caught the interest of the US Senate committee on Homeland Security as it involved a colossal amount of money that had been transacted and transferred across several countries over the past years.

Yesterday’s statement by the Swiss government has also further confirmed that in 2011 the Swiss government had indeed “provided legal assistance” to Hong Kong in relation to Musa’s alleged case of “criminal collusion in bribery and taking bribes”.

The government said that thus far in the Musa’s case, no such request for legal assistance has been made by Malaysia.

Over the past 15 years, Switzerland has returned 1.7 billion Swiss francs of illicit funds to the countries of origin, “more than any other finance centre of comparable size”.

Currently, the Egyptian government is pressurising Switzerland for the quick release of 700 million Swiss francs embezzled by the former Egyptian ruler, Hozni Mubarak.

    Weird science has worked wonders and the ice age has reached Sabah form Switzerland.

    It began when Musa tried to hide stolen millions in some Swiss bank account.

    However, the chill may have blasted the CM's and froze his heart for a moment only a word from his Kuala Lupmur overlords can freeze his money.

    So would UMNO be seen to act as a responsible world citizen and also to gain election points by selling out Musa?

    We know in our hearts that this is a non-event. If Najib signs Musa's death warrant by requesting the Swiss to freeze... it may lead to other repercussions locally not just for Sabah crooked politicians but also in KL.

    So for the moment they are all "safe" if no one in power spill the beans.

    The only positive is that it is officially confirmed Musa has stashed away millions in stolen wealth.

  4. Dari mana semua ini berlaku? Ini kerana ada pihak yang mendakwa Siasatan tersebut dijalankan ekoran aduan sekumpulan pejuang alam sekitar yang menuduh bank tersebut menyimpan hasil daripada pembalakan di Malaysia.

    Dalam kenyataan Kumpulan tersebut menerusi kumpulan Bruno Manser Fund (BMF) yang berpangkalan di Switzerland memfailkan aduan ke atas Musa pada Mei atas pertuduhan melakukan pembalakan haram dan pengubahan lebih daripada AS$90 juta menerusi UBS.

  11. Pembalakan haram memang berlaku dalam negeri tetapi mendakwa isu itu 'diperbesarkan' dengan alasan dakwaan AS$90 juta bersamaan dengan 20,000 hektar hutan ditebang. Itu semua cuma perangkap untuk rakyat mempercayainya.

  20. Tidak ada fakta lagi mengenai kes ini. Tapi kalau mahu fakta "Kebolehan datuk musa dalam pengurusan dan pentadbiran membuat ada pihak yang cemburu dan cuba menjatuhkan beliau dari jawatan KM tesebut." Yang pasti itu adalah faktanya.

    Aakibatnya ia akan “mengganggu” usaha pemuliharaan hutan di Sabah kerana ia mungkin akan “digugurkan” sebagai salah satu polisi negeri. Jadi fikirkannya bersama mengenai perkara ini.

  21. Datuk Musa dikaitkan dengan RASUAH tidak dihairankan lagi. Kerana kita tahu Datuk Musa adalah bersih dengan segala masalah peribadi.

    Sebab itu isu rasuah dikaitkan dengan Datuk. Kerana isu ini senang direka-reka oleh mereka yang pentingkan diri sendiri.

    Maka kita dapat lihat sendiri apa yang berlaku kepada Sabah iaitu satu perubahan kemajuan dan ekonomi negeri itu sendiri dibawah pentadbiran Datuk Musa Aman dan Kerajaan BN yang lain.

    Sekurangnya 800,000 hektar hutan Sabah adalah sebahagian atau sepenuhnya diperakui di bawah pelbagai sistem yang diiktiraf di peringkat antarabangsa seperti Forest Stewardship Council (FSC), Skim Pensijilan Balak Malaysia (MTCS)

    Kehadiran khabar angin ini adalah perkara yang dirancang oleh Pembangkang untuk menjatuhkan ekonomi Pembalakan Sabah. Tuduhan tersebut bakal akan menyebabkan penurunan dalam jualan balak dan menyebabkan hutan Sabah kehilangan nilai ekonomi.

  23. I am not so sure as to what this 'news' is reporting. If you google on this topic, most will crop out are related to the US tax evasion cases in Switzerland Undisclosed Offshores accounts, Mubarak, Jullian Assage, as tracing back India's lost fund (which was by the way is last year's news.

    I can't comprehend how exactly all of this tied to Musa Aman. All these issues have been recycled, re-write maliciously. There are NO concrete news to support as to what this article has written.

    It is just cheap journalism from the bottom of the gutter! Sabah has witness a miraculous economic boom since 2003 and there will be more to unfold. WE have seen that Sabah has manage to attract a huge sum of investment to the state this year. This is a strong testament to the leadership of Musa Aman.

  26. The Forestry Department acknowledges that illegal felling does exist in Sabah but no way near the scale and extent as allegedly reported. The allegations are therefore 'baseless and made with bad intention's (Mal fide) to discredit and lessen the effort and sacrifices made by the state government of Sabah, to achieve good forest governance and SFM (Sustainable Forest Management) in the shortest time possible, despite the economic financial and social challenges.

  27. Many more forest areas are being earmarked for certification as Sabah has set 2014 as the year for all long term licensed areas to be fully certified. The process of certification means independent third party on auditing the ground to access credibility.
