The Kuala Lumpur Syariah Court of Appeal has dismissed a qazaf (making false allegations) application by former opposition leader Anwar Ibrahim to prosecute his former aide Mohd Saiful Bukhari Azlan.
The three-man panel, chaired by Syariah Appeals Court judge Justice Md Yusup Che, Justice Yusof Musa and Mohd Amran Mat Zain unanimously dismissed the application today with RM5,000 in costs.
Justice Md Yusup made the order after Anwar failed to provide proof of the allegation.
Anwar who is also the former Permatang Pauh MP, filed an application at the Syariah High Court on Jan 7, 2010 seeking an order to compel then Federal Territory Syarie Prosecution head to proceed with the qazaf charge against Saiful, 25.
On April 14, 2010 the Syariah High Court dismissed Anwar’s bid to get the qazaf proceeding commenced after the court allowed the preliminary objections by the respondents ruling that it had no jurisdiction over the matter.
Anwar was represented by Syariah lawyer Kamar Ainiah Kamaruzaman.
On Feb 10 last year, the Federal Court upheld Anwar’s conviction and five-year jail term imposed by the Court of Appeal for sodomising Mohd Saiful in June 2008.
