Yong: Restore the two-term limit on TYT "Pulihkan semula had dua penggal bagi TYT"

Semua parti politik dan calon yang bertanding dalam pilihan raya Sabah akan datang mesti berjanji untuk memulihkan Perkara 2 (3) perlembagaan Sabah yang berbunyi: “Seseorang tidaklah boleh memegang jawatan sebagai Yang di-Pertua Negeri Sabah selama lebih daripada dua penggal sama ada secara terus menerus atau selainnya. " Artikel 2 (3) ini diluluskan semasa pemerintahan PBS 1987 untuk tujuan yang sangat baik.

Sebab utamanya cukup jelas. Sehingga Ketua Menteri hari ini tidak perlu berhadapan dengan kerumitan apabila TYT yang mengharapkan atau ingin dilantik semula melebihi dua penggal. Setiap 1 penggal adalah selama empat tahun.

Pada bulan Disember 2018, batas jangka waktu yang ditetapkan dalam Pasal 2 (3) perlembagaan dihapuskan. Secara sah, TYT kini boleh kekal sebagai TYT seumur hidup. Tidak ada jaminan oleh Ketua Menteri hari ini yang akan memuaskan hati rakyat bahawa penghapusan had istilah itu sama mulia seperti yang dituntut. 

Tidak kira siapa Ketua Menteri atau siapa TYT. Institusi TYT adalah perkara yang mesti kita lindungi.

Menifesto pilihanraya Warisan atau PH ataupun BN atau Gabungan Sabah mahupun parti politik yang lain pada PRU14 tidak menyatakan “had dua penggal pada jawatan TYT akan dihapus”. Mengapa kemudian, had penggal TYT dihapuskan?

All political parties and candidates contesting in the coming Sabah elections must pledge to restore Article 2(3) of the Sabah constitution which reads: “A person shall not hold office as the Yang di-Pertua Negeri for more than two terms either continuously or otherwise.” This Article 2(3) was passed during the 1987 PBS government for a very good reason.

The core reason is obvious. So that the Chief Minister of the day does not have to overcome the real headaches of a TYT who expects or wishes to be re-appointed beyond two terms. Each term is four years.

In December 2018, the term limit stipulated in Article 2(3) of the constitution was abolished. Legally, the TYT may now remain as TYT for life. No amount of assurances by the Chief Minister of the day will satisfy the people that the removal of the term limit is as noble as claimed. 

It does not matter who Chief Minister or who the TYT is.  It is the office of the TYT that we must protect.

It was not in the Warisan or PH or BN or Gabungan Sabah or any other party election manifesto that the two-term limit on the TYT post will be removed. Why then, was the term limit removed?
