SEDCO to get sand ‘monopoly’

KOTA KINABALU: The Land and Survey Department has proposed Sabah Economic Development Corporation (SEDCO) be given the monopoly to all the sand mining activities in Sabah, starting June next year.

Its director Datuk Osman Jamal, in proposing this yesterday, said it would help eliminate issues related to sand theft that state authorities currently have to deal with.

"We will use the first six months next year to prepare the paperwork and work out the mechanism and so on, taking into consideration the interest of everyone," he told reporters after the closing of the Land and Survey Department and Malaysia Anti-Corruption Commission (MACC) Roundtable Discussion here, yesterday.

Osman said the department would come up with a resolution on the proposal and meet with all the contractors involved to gather their views and inputs so that the mechanism to be developed would be best for all parties, namely the government, SEDCO and the operators.

According to Osman, the proposed exclusive mining rights approach has actually been agreed in principle by the State Government a few years ago but was not implemented due to the absence of a suitable mechanism and the need to give the operators time to get returns from their investment in sand mining activities.

"But come June next year, no sand excavation licenses would be renewed. Existing licenses will however be continued until they expire, and after that SEDCO can take over. For areas where there is no active license, SEDCO can go a head," he said.

Osman said contractors whose licenses have expired could still continue their businesses by applying to be an agent of SEDCO, and it is up to the monopoly holder to decide the criteria for the appointment.

"I think good operators will be accepted by SEDCO, whichever that has the quality, has their own machinery and so on.

"Actually this method is faster and more effective, as anyone who wants to deal with sand mining would only need to go to SEDCO.

"This time we will only need to issue one license, so we cut the time, no more bureaucracy.

"When SEDCO deal with business people, their ways are different. With the government you'll have to follow all this time consuming procedures," he said.

Osman said that from the state's point of view, this is the best approach in managing the sand resources as it would ensure no revenue losses due to sand dredging.

He said the Government will charge SEDCO in advance based on the volume of the sand, which will be determined by the Geoscience Department.

Asked if the Government could assure there would be no or less illegal sand mining once the monopoly is in place, he said SEDCO would be inclined to monitor sand theft activities as basically it would be their property that would be stolen and not the Government's.

This would allow the department to utilise its enforcement officers to focus more on other tasks, such as detecting encroachment on state land, he said.

"This will allow us to concentrate on other matters, so a lot of good things will come from this," he said.
"Under the new system, the responsibility about sand theft would no longer exist, we no longer need to enforce because all the sand is already exclusive to SEDCO.

“So SEDCO has to take care of it, meaning the Government would no longer need to waste resources guarding against sand thieves, because all would be taken care of by SEDCO themselves," he said.
According to Osman, the contractors have yet to be informed about the proposed move.

Asked if SEDCO had the mechanism and capability to monitor sand theft, he said: "Right now the department has to look out for sand theft because the sand still belongs to the government, but in this case SEDCO will pay us in advance so there will be no losses to the Government."

As to who will take action against sand thieves, he indicated that SEDCO as the "owner" may be given certain powers to deal with the problem.

  1. Neverending stories of 'crook and hook' arrangement to thieve away another underground resource from Sabah or ongoing at least near future in KK Lands!
    All these crook or so-called crooked think deep not because of learning from their religious background to do good but with greed to steal or cheat public revenue from the Lands.
    Sabahan must rise to launch another watchdog protest on this.A good example to learn from other State such like in Selangor.All these mainly UMNO's mastermind with hidden ugly jobs always.Sabah should not be a place for them whether is SEDCO, or whatsoever government link-co alright!

    Mengapa dan siapa yang bertanggung jawab?Negeri ataupun Rakyat dah cukup menderita kenapa masih ada golongan buruk ni mencari kekayaan sendiri membeban hidup kita.
    Patut mereka mainkan peranan mencadangkan undang lebih teliti mempertahankan harta-harta negeri.
    Cukup dukahati bagi rakyat Sabah dengan tindakan mereka ni.

Bagi saya idea memberikan SEDCO yg merupakan badan kerajaan utk mengawal dan menyelia pengeluran dan pembelian pasir adalah baik.Melalui hak ini, kerajaan akan dengan mudah mengenalpasti pencuri-pencuri pasir di Sabah. Walaubagaimanapun, ianya adalah TEORI semata-mata. Saya sokong jika kerajaan atau GLC yang mengawal dan menyelia pengeluaran pasir di Sabah tetapi seperti yang semua kita maklum bahawa JIKA kaedah ini dilaksanakan dengan TELUS dan JUJUR, pastinya menguntungkan kerajaan negeri. Dalam keadaan sekarang, mencari individu yang amanah sama seperti mencari jarum dalam jerami maka saya rasa kaedah yang sama tetapi pendekatan yang berlainan perlu diperkenalkan.Saya tidak akan memberitahunya kerana ramai yang pandai di luar sana.Berbalik kepada SEDCO, lihat sahaja (perbetulkan kalau saya silap) pengerusinya! bukankah pengerusinya berkaitan dengan ketua menteri? semuanya berkaitan.mungkin OJpun mahu angkat kaki CM atau mungkin CM yg mengarahkan OJ mencadangkan pekara tersebut supaya tidak kelihatan bahawa ada campurtangan politik.cuba fikirkan.CM kita memang mahir dalam berniaga kerana dia pernah menjadi seorang peniaga, kontraktor dll. Apapun, banyak perkara negatif jika sesuatu sumber semulajadi dimonopoli.

  9. Exploration or whatever dig or mine of any underground materials will destabilize strata from the geo-science or geological know how and really something beyond the said of any unprofessional or greed men include those with desire even he could be highest in position.
    It could be a better filtered responsibility to safe guard the nature by setting up a board of expertise from relevant field rather just let this so-called SEDCO or whatever entity to handle with full power.

    Before issuance of any licences to any party should be previewed and reviewed by THE BOARD or BODY of experts team responsible directly to furnish a reports in quarterly of a year to State Assembly and gazetted officially in public media prior to approval.

    What the hell is SEDCO or That OJ can be held with sufficient responsibility suppose with in deep look into the aspect of geo-science aspect of extracting or removing sand or natural material that will affect or change the porosity or solubility or even geological system of underground strata.Include many irresponsible development companies too mere focus on getting quick earn or rich to practice something not right by bribing the consultants or mislead the common community.By seeing the surrounding places in City of KK itself no need to go far one can spot many loopholes in the jobs of planning and implementation from environmental to infra-structural aspect of projects or even those artificially man-built obstacles around.
    Man live with comfort of nature please live more godly as Man with responsibility rather than for your own greed alright.
    You shall be judged or taken for the task one day when your time come soon.
    As example where can you find any logic of digging tunnel or drains to curb or prevent flood while water-level in a low lying city had not been noted for a better technique to do so.You may just see it in simple way like keep pumping water inside the same aquarium yet pouring water from outside like dropping from the sky.Then tell everyone how is the job that had been done with waste of cost!
    Lacking wisdom or be more responsible is adding burden not to yourself but the people who rely on your role.So take a breath and do some good job or just let a better person to do it right!

  10. It is an insult to even suggest that Land & Survey Dept cannot control sand theft and for its director to admit it openly, he should resign immediately. Nothing will work if you do not have a proper tendering system on minig sites, irrespective of under L & S Dept or SEDCO.

  15. jooney anda salah. SEDCO diberi kuasa ekslusif mengenai pengambilan pasir.Kita mesti faham bahawa SEDCO bukan "mengambil pasir" tetapi diberi KUASA untuk mengambil pasir. Oleh itu, SEDCO akan memohon kepada Jabatan Tanah untuk pengambilan pasir di kawasan-kawasan tertentu dan secara pentadbirannya, Jabatan Tanah dan Ukur serta jabatan terlibat tidak ada pilihan selain membenarkan SEDCO. Setelah diluluskan, SEDCO akan MELANTIK (lihat perkataan MELANTIK), sesiapa sahaja yang layak untuk mengambil pasir berkenaan. Sekarang kuasa melantik operator pengambilan pasir ini adalah pada SEDCO. Kan mudah sekarang cari duit.Guna nama SEDCO utk dapatkan kawasan dan kemudian setelah lulus, SEDCO guna pendekatan Joint Venture dengan syarikatluar untuk ambil pasir.Inilah caranya "mencuri" secara halal dan tidak menyalahi undang-undang walaupun ianya tidak beretika. fikirkan?

  16. Sokong penuh pendapat atau penerangan ditulis oleh Anon Dec 17,2011 5:35PM cukup jelas bagi peranan antara SEDCO,KUASA Dan MELANTIK.

    Keadaan ni sentiasa berlaku oleh kumpulan tertentu yang suka memainkan kesempatan membodohkan rakyat rampas hak asasi dari Sabah khasnya.

    Biarpon ada undang tetapi apabila sudah jadi mereka ni juga terlepas hanya 'kambing hitam' disalahkan.

    Harap bukan saja MACC tapi tindakan mesti diambil supaya perampas ni tidak mungkin berjaya sekali lagi.Sepatutnya kuasa mereka mesti dihadkan dan mereka mesti dipindah kuasa dalam satu jangka masa tidak terlalu panjang memegang jawatan urusan di satu pejabat!

  22. Whats the problem of appointing our own GLC's to do the sand mining?

    I believe that SEDCO has the capacity & abilities to do it. The land & Survey Department director would not making this proposal blindly without thinking the pro & cons first.

    The reality is, the illegal sand mining will always going to happen, no matter how best the relevant agency implementing the rules. by giving monopoly to SEDCO, the least that land survey department can achieved is to minimize the crime...

SEDCO akan melantik syarikat untuk mengurus perniagaan pasir iaitu sebagai sole agent.Satu cara lagi SEDCO akan menubuhkan anak Syarikat nya iaitu Syarikat subsidiary dimana pemegang sahamnya adalah daripada SEDCO dan individu tertentu.Fikirkan lah dan selidik lah siapa individu tersebut.Saya pun minat nak tahu.

    Mungkin YTL boleh bantu selidik kerana begini lah 'modus operandi' yang bakal di laksanakan oleh SEDCO.Saya tidak mungkin 'salah tikam' dalam hal ini.Percaya lah.

  61. rupa-rupanya OJ salah seorang ahli lembaga pengarah dalam SEDCO.betul ke info ini? jika betul, maka menjadi kesalahan kpd OJ kerana bersifat double standard atau menggunakan kuasanya utk mencadang supaya SEDCO berjaya memonopoli industri pasir ini. org putih bilang ada " conflict of interest"lah ni.sesiapa sudi lapor dgn MACC.walaupun belum diluluskan atau sekadar baru cadangan, OJ tidak boleh melupakan kepentingan "interest" Sedco kerana dia Pengarah Tanah Ukur.Memang hebat susunan kroni walau cara tidak beretika.

    Look at the monopolise of: Rice, Sugar, telecommunications, electricity, water, cement, special licenses, on import of steel, cars APs, petroleum businesses..., they are good for BN-UMNO croonies, BAD BAD BAD for the rakyat!!!
