Borneonisation suit set on July 23

KOTA KINABALU, Monday 18 June 2012 - The Kota Kinabalu High Court today has fixed July 23 as the next mention date in the "Borneonisation"  case brought by retired police inspector Bernard Fung Fon Chen, 70,  and ex-teacher Mohd Nazib Maidan Dally, age 35, against the Federal and Sabah State governments for allegedly failing to implement the Borneonisation of the public service in Sabah as promised in the Malaysia Agreement 1963 and the Inter-Government Committee Report.

Justice Datuk David Wong Dak Wah has also given the defendants until 18 July to file their affidavits in opposition.


The KK High Court had on May 25 dismissed the application of the Federal and State governments to strike out the "Borneonisation" suit ruling, among others, that the plaintiffs have the right and the locus standi to come to court for the court to decide whether the government has failed to implement the undertakings and assurances contained in the Malaysia Agreement of 1963.

Counsel for the Sabah State Government today informed the High Court that the State Government is appealing against the Court dismissal of the government's application to strike out the suit. Puan Nur Aimi Binti Arazmi appeared for the Federal Government while Mohammad Bin Abd Sani appeared for the State Government.

Present in court today was lawyer for the plaintiffs Peter Marajin with Nazib Maidan accompanied by Likas Assemblyman who is also SAPP Deputy President Datuk Liew Teck Chan and other SAPP members who came to show moral support.
