Jeffrey requests to meet CM Musa on Sabah issues

KOTA KINABALU - “Bingkor Assemblyman cum STAR Sabah chief, Dr. Jeffrey Kitingan, has requested to meet Chief Minister Datuk Seri Panglima Musa Aman on a list of Sabah issues following up from the Chief Minister’s call to meet him at his office at the last State Assembly sitting in April” said STAR Sabah in a press statement released earlier today.

It is with the intention of promoting the rights, interest and welfare of Sabah and Sabahans and the better development and progress of Sabah and Sabahans and to contribute towards the future well-being and prosperity of Sabah and Sabahans, STAR Sabah and Dr. Jeffrey have submitted a list of Sabah issues and issues affecting Sabah and Sabahans for the proposed meeting with CM Musa.

This list of Sabah issues which are important areas are:-
  1. Basis of federal-state relationship including the restoration of TYT Yang DiPertua Negara and the restoration of Sabah as an equal partner to Malaya and Sarawak;
  2. Review and implementation of the Malaysia Agreement 1963 and the IGC Report including the 20-Points and the re-activation of the IGC as the monitoring mechanism for the Malaysia Agreement;
  3. Sabah oil and gas resources, including actions on the legality of the Petroleum Development Act, 1974, the legality of the Vesting of Sabah’s oil and gas resources to Petronas on 26 March 1975, and the establishment of Sabah Petroleum Advisory Council, PetroSabah Corporation, PetroSabah Sovereign Wealth Fund and the development of a Sabah-based oil and gas industry led by PetroSabah and mandatory participation of Sabah and Sabahans in Sabah’s oil and gas resources and development;
  4. Finance and economy, including revenue sharing with the federal government, return of 40% net revenue collected from Sabah, diversification of revenues for Sabah to insulate/develop Sabah’s economy, imposition/exemption of GST in Sabah and Sabah’s own sales and service tax and the abolishment of the Cabotage Policy;
  5. Homeland Security, Immigration and Registration in Sabah, including setting up Sabah’s own Homeland Security Ministry/Department, Sabah State Troopers, Sabah Border Scouts and other security arrangements, Sabah IC and Sabah Resident IC, RCI and issues relating to illegal immigrants and foreign labour in Sabah;
  6. Land and NCR matters, including the reviewing and updating policies on NCR lands and alienation of lands with priority for natives and Sabahans, resolution of NCR claims and LA with NCR rights, setting up of Land Tribunal and resolution of land disputes, extension of land use of NT titles to include residential, commercial and industrial use, establishment of Native Land Foundation, native reserves, communal titles and lands adjacent to communal titles as native reserves;
  7. Education in Sabah, including setting up of own Sabah State University and own Sabah technical/vocational institutes, upgrading of Institut Pertanian Timbang Mengaris into an Agro-Forestry University and   Kolej Yayasan Sabah into a Yayasan Sabah University College, autonomy of administration of education in Sabah, human capital development and development of Sabah youths with opportunities for entrepreneurship and better careers;
  8. Empowerment of Natives under Article 41 of the Constitution of Sabah, including business and entrepreneurial development and opportunities for Natives, educational opportunities and scholarships for Natives, enforcement of Pukonsa and Sabah licensing at all levels;
  9. Funding and improvement of infrastructure and basic amenities including the overall development in Sabah and the building of a monorail system in Kota Kinabalu;
  10. Review, coordinate and re-structuring of government and administration in Sabah based on nationhood status, including re-designating head of government as Prime Minister of Sabah, re-naming State Legislative Assembly as Parliament of Sabah; division/regionalizing Sabah into 5 Regions and 2 Special Administrative Regions, implementation of Borneonisation,  reviewing the roles and presence of federal agencies in Sabah, upgrading and enhancement of Sabah government agencies and channelling of federal funds for federal projects directly and implementation of federal projects in Sabah under Sabah government;
  11. Health administration and management in Sabah;
  12. Rejection of race and religion policies from West Malaysia/Umno and the safeguarding of racial and religious harmony in Sabah including the barring of activists and racist members from entry into Sabah.
The resolution of these Sabah issues will benefit not only Sabah but also Malaysia as a whole especially when the nation is facing so many problems that is tearing the country apart.

At the same time, Dr. Jeffrey has also submitted a Motion for debate at the forthcoming Sabah State Assembly beginning 14th July.   The Motion in on the review of the constitutionality of the Petroleum Development Act, 1974 as well as the legality of the Petroleum Agreement signed by then Chief Minister of Sabah on 14 June 1976 and the authority of the Chief Minister in signing the same.   The Motion was rejected from debate at the last Assembly session in April.

LIST OF SABAH ISSUES OF CONCERN TO SABAH AND SABAHANS

Objective of promoting the rights, interest and welfare of Sabah and Sabahans and the better development and progress of Sabah and Sabahans.

The List of Issues are;
  1. Basis of federal-state relationship including:-
    a) the restoration of TYT Yang DiPertua Negara;
    b) the restoration of Sabah as an equal partner to Malaya and Sarawak;
    c) the appointment of Deputy Prime Minister of Malaysia from Sabah;
    d) increase in senatorial appointments to not less than 11 Senators for Sabah;
    e) recognition, rejection and or modication and/or variation of federal legislation through the State Assembly;
    f) re-delineation of Parliamentary seats to provide 35% representation from Sabah and Sarawak;
    g) appropriate and adequate federal funding for Parliamentary and State Assembly constituencies in Sabah;
  2. Review and implementation of the Malaysia Agreement 1963 and the IGC Report including the 20-Points and the re-activation of the IGC as the monitoring mechanism for the Malaysia Agreement;
  3. Sabah oil and gas resources, including actions on:-
    (a)         the legality of the Petroleum Development Act, 1974;
    (b) the legality of the Vesting of Sabah’s oil and gas resources to Petronas on 26 March 1975;
    (c) the legality of the Oil Agreement dated 14 June 2014 including the powers of the Chief Minister to sign the same;
    (d) formation of a Sabah Petroleum Advisory Council;
    (e) establishment of PetroSabah Corporation and the development of a Sabah-based oil and gas industry led by PetroSabah;
    (f) establishment of PetroSabah Sovereign Wealth Fund and investments for the future and benefit of all Sabahans;
    (g) ownership of shares in Petronas;
    (h) imposition of royalties, rents and other payments on oil and gas producing areas in Sabah;
    (i) mandatory participation of Sabah and Sabahans in Sabah’s oil and gas resources and development;
  4. Finance and economy, including:-
    (a) revenue sharing with the federal government;
    (b) return of 40% net revenue collected from Sabah;
    (c) diversification of revenues for Sabah to insulate/develop Sabah’s economy;
    (d) imposition/exemption of GST in Sabah and Sabah’s own sales and service tax;
