RANAU - A group of Sabahans took the opportunity to mark World Human Rights Day at Kg. Kibbas, an idyllic countryside village nestled between Kundasang and Ranau, not far from foothills of the majestic Mount Kinabalu, to highlight some basic human rights issues confronting Sabah.
If the settings were appropriate, it was more meaningful for Kg. Kibbas where the native villagers recounted how in 2012 they had carried out a protest with placards and banners demanding for clean treated water to be supplied to the village. Eventually, the government relented and quickly installed pipe facilities for the water supply, perhaps due to the then pending GE-13 elections.
Development was not only promised by the ruling BN government election candidates for many elections but was actively campaigned by USNO in Ranau before 1963 that forming Malaysia will bring progress to Sabah and in particular to Ranau area.
It was sad that parts of Kg. Kibbas only received clean water in 2012, in the 50th year of the formation of Malaysia. Yet, it is more sad that in many villagers throughout Sabah, and even neighbouring Sarawak, still do not have clean treated water even though it is the most basic of human needs and a human right regardless of race, religion or creed.
In a show of solidarity, the Kibbas villagers were joined by villagers from MAWASI comprising Kg. Malinsau, Kg. Wayan and Kg. Sinurai where there is an on-going land dispute. They were also joined by volunteers led by Jalibin Paidi from SSPR, Semangat Satu Perjuangan Rakyat, who had come to the aid of the Mawasi villagers recently to prevent the destruction and desecration of the ancestral native lands in Mawasi.
The dispute was caused by Sabah Lands and Surveys Department in alienating and issuing a title over part of the ancestral native customary lands to an outside land applicant who was a former state assemblyman and which was subsequently sold to a Malayan-based company. The dispute is still pending before the Court of Appeal.
Jalibin advised the crowd that as natives in Sabah, Sabah is their only home and they need to protect and safeguard their native customary rights to their lands as they have no other place to go if their lands are seized by outsiders. This is because for the indigenous natives, land is the very essence of their lifes.
The rights of indigenous people to their customary lands are recognized in the United Nations Declaration on the Rights of Indigenous Peoples which was adopted by the United Nations General Assembly during its 61st session on 13 September 2007.
The Sabah government should recognize the natives to land in Sabah and prioritize lands in Sabah for Sabah natives and not partake in the alienation of lands to outsiders. Neither should the Sabah government herd the natives into communal grant lands just like the Red Indians were herded into Indian Reservations in America.
In his address, Dr. Jeffrey Kitingan, STAR Sabah Chief, cum Bingkor State Assemblyman clarified that human rights for the natives does not only involve land rights and rights of basic living amenities but also includes in the present content of Sabah, the right to eradication of poverty, the right to statehood and right to self-determination of the indigenous people. It also includes the right to freedom.
They are set out in the Universal Declaration of Human Rights which contains a broad range of political, civil, social, cultural and economic rights and adopted by the UN on 10 December 1948.
In the Sabah context, the UN in its world report had stated that Sabah is the poorest State in Malaysia with 40% of all poor in the nation. This is supported by the EPU statistics of the PM’s Department.
As for Sabah rights, it is within the legal rights of Sabahans to demand for Sabah’s rights and it is wrong of the federal government to threaten Sabahans with arrests under the Sedition Act when the federal government is the guilty party in failing to honour its obligations to Sabah and Sarawak as agreed in the formation of Malaysia in 1963.
“These Sabah rights need to be now claimed by Sabahans since government leaders cannot be trusted to reclaim them. And if the people do not rise and act, Sabah will lose these rights including its oil and gas resources forever” added Dr. Jeffrey.
Dr. Jeffrey concluded by slamming the failure of the federal government in resolving the illegal immigrants issue in Sabah and for them to grant citizenships to foreigners unlawfully as well as giving away Sabah’s political franchise to foreign voters and creating the insecurity situation in Sabah. All of which are tantamount to reverse ethnic cleansing and a deprivation of the human rights of the natives who have fundamental human rights which should be honoured by governments and cannot be taken away as called for by UN Secretary-General Ban Ki-moon in the Slogan for Human Rights Day 2015 – Human Rights 365:
"I call on States to honour their obligation to protect human rights every day of the year. I call on people to hold their governments to account".
Several NGOs including SSPR, BHF, SBS, NBFM, SFM and BYR ended the gathering of about 100 people with a resolve to re-claim Sabah rights including its oil and gas resources as well as to demand that the Sedition Act be repealed and the government to respect and implement human rights for Sabahans including the supply of clean treated water throughout Sabah, respecting native customary rights to native lands and the eradication of poverty.
The crowd and Dr. Jeffrey also recorded their appreciation for cooperation of the police personnel from IPD Ranau who had acted professionally and friendly throughout the event in ensuring it went on smoothly and safely and in helping to control the passing traffic.

RANAU - Sekumpulan rakyat Sabah mengambil kesempatan untuk menandakan Hari Hak Asasi Manusia SeDunia di Kg. Kibbas, sebuah perkampungan desa yang indah terletak di antara Kundasang dan Ranau, tidak jauh dari kaki bukit Gunung Kinabalu, untuk mengetengahkan beberapa isu-isu hak asasi manusia yang dihadapi Sabah.
Walaupun persekitaran yang bersesuai, ia adalah lebih bermakna untuk Kg. Kibbas di mana penduduk pribumi menceritakan bagaimana pada tahun 2012 mereka telah menjalankan protes dengan membawa placard dan sepanduk kain rentang menuntut agar air bersih terawat dibekalkan kepada kampong halaman mereka. Akhirnya, kerajaan mengalah dan cepat dipasang kemudahan paip untuk bekalan air, mungkin kerana ketika itu hangat menjelang PRU-13.
Pembangunan bukan sahaja dijanjikan oleh calon pilihan raya BN bagi banyak pilihan raya yang lalu tetapi juga telah dikempen secara aktif oleh USNO di Ranau sebelum 1963 untuk meraih sokongan rakyat bagi membentuk Malaysia atas harapan bahawa Malaysia akan membawa kemajuan kepada Sabah khususnya ke kawasan Ranau.
Ia adalah menyedihkan bahawa sebahagian Kg. Kibbas hanya menerima air bersih terawatt pada tahun 2012, pada tahun ke-50 pembentukan Malaysia. Namun, ia lebih menyedihkan bahawa di kebanyakan kampung di seluruh Sabah, dan juga jiran Sarawak, masih tidak mempunyai air bersih terawatt walaupun ia merupakan keperluan manusia yang paling asas serta suatu hak asasi manusia tanpa mengira bangsa, agama atau kepercayaan.
Sebagai tanda perpaduan, penduduk kampung Kibbas disertai oleh penduduk MAWASI yang terdiri daripada Kg. Malinsau, Kg. Wayan dan Kg. Sinurai dimana satu pertikaian tanah masih berterusan. Mereka juga telah disertai oleh sekumpulan sukarelawan yang diketuai oleh Jalibin Paidi dari SSPR, Semangat Satu Perjuangan Rakyat, yang telah memberi bantuan kepada penduduk kampung Mawasi baru-baru ini untuk mengelakkan pencerobohan dan pemusnahan tanah adat nenek moyang di Mawasi.
Pertikaian ini disebabkan oleh Jabatan Tanah dan Ukur Sabah meluluskan dan mengeluarkan geran tanah untuk sebahagian daripada tanah adat kepada pemohon tanah dari luar yang merupakan mantan ahli Dewan Undangan Negeri, yang kemudian telah dijual kepada sebuah syarikat Malaya. Pertikaian itu masih menunggu pendengaran di Mahkamah Rayuan.
Jalibin menasihatkan orang ramai bahawa sebagai anak negeri di Sabah, hanya Sabah tanah tumpah darah mereka dan mereka perlu melindungi dan menjaga hak tanah adat mereka keatas tanah adat mereka kerana mereka tidak ada tempat lain untuk pergi jika tanah mereka dirampas oleh orang luar. Ini kerana bagi penduduk pribumi asal, tanah adalah intipati kehidupan mereka.
Hak-hak orang asal keatas tanah adat mereka diiktiraf dalam Deklarasi Bangsa-Bangsa Bersatu mengenai Hak Orang Asal yang telah diterimapakai oleh Perhimpunan Agung Bangsa-Bangsa Bersatu semasa sesi ke-61 pada 13 September 2007.
Kerajaan Sabah harus mengakui penduduk asal tanah adat di Sabah dan harus mengutamakan pemberimilikan tanah Sabah bagi anak negeri Sabah dan tidak terlibat dengan pemberimilikan tanah kepada orang luar. Kerajaan Sabah juga tidak harus mengumpulkan orang anak negeri ke dalam tanah geran komunal seperti orang Red Indian dipaksa berpindah ke Penempatan Red Indian di Amerika.
Dalam ucapannya, Dr Jeffrey Kitingan, Ketua STAR Sabah, merangkap Ahli Dewan Undangan Negeri Bingkor menjelaskan bahawa hak asasi manusia bagi anak negeri bukan sahaja melibatkan hak-hak tanah dan hak kemudahan asas kehidupan tetapi juga termasuk dalam konteks semasa Sabah, hak untuk pembasmian kemiskinan, hak untuk kenegaraan dan hak untuk penentuan diri oleh orang asal. Ia juga termasuk hak kepada kebebasan.
Mereka adalah seperti yang dinyatakan dalam Deklarasi Hak Asasi Manusia Sejagat yang mengandungi pelbagai hak-hak politik, sivil, sosial, budaya dan ekonomi yang diterimapakai oleh PBB pada 10 Disember 1948.
Dalam segi Sabah, PBB dalam laporan dunianya telah menyatakan bahawa Sabah adalah negeri yang termiskin di Malaysia dengan 40% daripada semua orang miskin di negara ini. Ini disokong oleh statistik EPU Jabatan Perdana Menteri.
Bagi hak-hak Sabah, ia adalah suatu hak rakyat Sabah untuk menuntut hak-hak Sabah dan kerajaan persekutuan tidak harus mengugut rakyat Sabah dengan tangkapan di bawah Akta Hasutan apabila kerajaan persekutuan adalah pihak yang bersalah apabila gagal menunaikan tanggungjawab kepada Sabah dan Sarawak seperti yang dipersetujui semasa pembentukan Malaysia pada 1963.
“Kini hak-hak Sabah perlu diperjuangkan oleh rakyat Sabah sebab pemimpin kerajaan tidak boleh dipercaya untuk menuntutnya demi membela rakyat. Sekiranya rakyat Sabah tidak bangkit bertindak, hak-hak Sabah termasuk hakmilik minyak dan gasnya akan lesap selama-lamanya” ujar Dr. Jeffrey.
Dr Jeffrey juga membidas kerajaan persekutuan kerana gagal menyelesaikan isu pendatang tanpa izin di Sabah dan memberi mereka kad pengenalan dan kerakyatan secara menyalahi undang-undang dan juga memberikan francais politik Sabah kepada pengundi asing. Mereka juga mewujudkan keadaan tidak selamat di Sabah.
Di mana kesemuanya adalah sama seperti pembersihan etnik terbalik dan melucutkan hak asasi manusia kaum pribumi yang mempunyai hak-hak asasi manusia yang perlu dihormati oleh kerajaan-kerajaan dan tidak boleh dicabuli selaras dengan saranan Setiausaha Agung PBB Ban Ki-moon dalam Slogan untuk Hari Hak Asasi Manusia 2015 - Hak Asasi Manusia 365:
"Saya menyeru kepada negara-negara untuk menghormati kewajipan mereka untuk melindungi hak asasi manusia setiap hari, sepanjang tahun. Saya menyeru kepada rakyat untuk memegang kerajaan mereka supaya bertanggungjawab".
Hadirin yang berjumlah lebih kurang 100 orang terdiri dari pelbagai NGO termasuk SSPR, BHF, Solidariti Belia Sabah, NBFM, SFM dan BYR, mengakhiri himpunan dengan keazaman menuntut hak-hak Sabah termasuk minyak dan gas serta desakan bahawa Akta Hasutan harus dimansuhkan, kerajaan menghormati dan melaksanakan hak-hak asasi untuk rakyat Sabah termasuk pembekalan air bersih terawat ke seluruh Sabah, penghormatan hak asasi tanah adat and pembasmian kemiskinan.
