Chief Justice: Perform your duty without fear or favour

Out-going Chief Justice Arifin Zakaria today reminded judges to fulfill the public’s expectations in carrying out their judicial functions with responsibility and full of wisdom.

“You must use your legal knowledge and experience to produce judgments in accordance with law,” Arifin said in his speech at the oath-taking ceremony here to elevate a Federal Court judge and 10 High Court judges.

Arifin, who will retire next month, told his subordinates to always remember that judges were “the pillars in our entire justice system” as they were the referees between individuals or between individuals and the state.

On that score, he urged them to observe the law based on the Federal Constitution, laws passed by the legislature and follow legal principles approved by superior courts.

He said laws and court judgments were there to regulate and maintain order in society.

“Judges must then equip themselves with legal knowledge and experience to ensure the laws were developed in line with current development,” he said.

He said in the age of technology, information was spread fast to the public, especially through the social media.

“The public are able to read our judgments but at the same time the rulings are open to criticism from academics, journalists and politicians,” he added.

“The barometer is your own conscience. If your conscience is clear than you have nothing to fear,” he said.

Arifin urged the judiciary to engage the media as it was the best way to reach out to the public.

High Court judges Azimah Omar, M Gunalan, Lim Chong Fong, Nordin Hassan, Azmi Ariffin, Noorin Badaruddin, Collin Lawrence Sequerah, Azizul Azmi Adnan, Mohamed Zaini Mazlan and Mohd Nazlan Mohd Ghazali took their oath before Chief Judge of Malaya Zulkefli Ahmad Makinudin.
