BN is covering up its failure through State AG

KOTA KINABALU: Sabah Progressive Party (SAPP) claimed the State Government is using the State Attorney General to justify its failure to protect the Native Customary Right (NCR) of the people in Sabah.

Deputy President Datuk Eric Majimbun said Datuk Roderic Fernandez's statement was also to defend the "barbaric eviction and burning of natives houses".

He said it was puzzling to note the reaction of the various state Barisan Nasional (BN) component parties to Fernandez's statement, who in the first place is appointed by the State BN government.

"To brush it aside as Fernandez's own personal view is tantamount to disrespecting the position of the State Attorney General who is supposed to be the legal advisor for the government," he said.

"As the State Attorney General surely his opinion matters," he said here Sunday.

In this respect, Majimbun said the BN should not put the blame on the Attorney General but to themselves for failing to protect the NCR of the natives who were losing their land to big corporations.

As for SAPP, he said its Land Reform policy that was launched last year would address all the problems and return the land to the rightful owner that is the natives of Sabah.

  1. Jelas dan Nyata bahawa penduduk Asal Sabah tidak mempunyai Hak dan Taraf dimata BN UMNO kerana Dusun,Tambanuo,Bajau Sama,Irranun,Bisaya,Murut,Sungai,Berunai adalah bukan Melayu.

    Masalah ini semuanya timbul bila mana BN UMNO datang ke Sabah,Pengarah Perhutanan,Pengarah JTU dan AG semuanya kaum kerabat Musang Amang. Pengara Perhutanan,Pengarah JTU dan AG ini siapa dia yang BUMIPUTERA?

Menurut kenyataan Tan Sri Bernard Dompok, pada perasmian Program Pengembangan Ekonomi Belia Pasokmomogun Berasaskan Penanaman Getah dan Kelapa Sawit di Kg Taginambur di Kota Belud (27 Jan 2012), beliau meminta penduduk kampung yang tidak bertanah dan bersungguh-sungguh memajukan tanah NCR akan diberi pertimbangan untuk memiliki tanah itu.Penduduk harus terlebih dahulu menunjukkan komitmen dengan mengusahakan tanah-tanah NCR dengan tanaman komersial bagi membolehkan kerajaan menilai minat dan kesungguhan mereka sebelum geran tanah diberikan. Menurut beliau juga, isu tu sudah pun dibincang dengan KM Datuk Seri Musa Aman dan perkara itu diteliti untuk kebaikan rakyat.

      KOTA KINABALU: The Sabah Government takes the issue of Native Customary Land Rights (NCR) seriously and will look for the best solution which results in a win-win situation for all.

      Chief Minister Datuk Seri Musa Haji Aman urged those reacting to Sabah Attorney-General Datuk Roderick Fernandez’s recent statement on the NCR issue, not to be unduly worried.

      “I will bring this matter to the Cabinet for in-depth discussion with my colleagues, and also invite Barisan Nasional (BN) component party leaders to discuss the issue,” he said in a statement here yesterday.

      Musa said the state government would also be seeking the opinion of the legal fraternity, especially experts on land matters.

      “The important thing is that we can sit down and resolve this issue and find a solution. Until then, there is no point for us to debate over the matter, via the media,” he added.

      Several state BN component party leaders, including United Pasokmomogun Kadazandusun Murut Organisation president, Tan Sri Bernard Dompok and Parti Bersatu Sabah deputy president, Datuk Seri Dr Maximus Ongkili have expressed disagreement over Fernandez’s interpretation of the NCR provision in the Sabah Land Ordinance (SLO) that there is “no NCR land after 1930”.

      Describing it as a wrong interpretation, he said that unlike in Sarawak, there was no cut-off point with regard to NCR land in the context of Sabah.

      On Thursday, Fernandez was quoted as saying that no fresh NCR land could be created as only land “still” occupied by natives, prior to the date when the SLO came into force, are recognised with the status.

  22. pihak kerajaan seharusnya memperjuangkan matlamat mereka dalam menyelesaikan masalah penyelewengan tanah yang kian berleluasa di Sabah, supaya penduduk terlibat tidak terasa tertipu..
