Home Minister Ahmad Zahid Hamidi can be charged for claims he made in a letter to the United States’ Federal Bureau of Investigation vouching for accused kingpin Paul Phua, Lawyers for Liberty (LFL) said.
LFL director Eric Paulsen said the fact that Putrajaya had retracted Zahid’s letter throws doubt over whether Phua did assist the government in security projects, as Zahid claims.
Calling the letter “shocking”, Paulsen said the minister must reveal what these projects are, or he can face charges under the Penal Code.
“If the content of the letter is not true, then the home minister would have prima facie committed a gross abuse of power and possibly, various offences under Chapter XI of the Penal Code – ‘False Evidence and Offences against Public Justice’,” he said.
“Either way, we call upon the home minister to come clean over the content the letter, failing which he should resign in disgrace.”
Phua’s lawyer Muhammad Shafee Abdullah on Saturday said Zahid had written the letter published by Hong Kong’s South China Morning Post on Shafee’s request.
The letter states that Phua is not a member of the Bangkok-based 14K triad which are involved in illegal drugs, gambling and money laundering.
Zahid also said that Phua had assisted the government in security projects and that he is eager for the accused to be released.
However, an FBI document sighted by Malaysiakini states that Nevada District Court after Putrajaya objected to it being used for the defence of an alleged gambling kingpin.
