KOTA KINABALU - The case of two former civil servants suing the Federal and Sabah governments for allegedly failing to implement the Borneonisation of the public service in Sabah as promised in the Malaysia Agreement 1963 and the Inter-Government Committee Report will go for a full trial in October.
Kota Kinabalu High Court Judge Datuk David Wong Dak Wah fixed Oct 15 for the trial to hear arguments from both the plaintiffs, retired police inspector Bernard Fung Fon Chen, 70, and ex-teacher Mohd Nazib Maidan Dally, 35, as well as the defendents.
The court has also given the first defendant, Federal Government to file their affidavits in opposition by Sept 18.
The Federal Government would not be allowed to file their affidavits if unable to do so by the given time.
Justice Wong had on July 23 ordered the Federal Government to file their affidavits in opposition by Aug ust 24 but the defendant had requested more time.
Counsel Nur Aimi Binti Arazmi appeared for the Federal Government told Justice Wong that the defendant is requesting one more month to file their affidavits on reason that they are still waiting for the report from the Police Commission and the Education Commission.
Counsel Ken Yong representing the plaintiffs contended that the Federal Government is delaying the hearing with such excuses.
Yong told the court that it is a delaying tactics by the Federal Government because to take such a long time to obtain the affidavits is unbelievable.
The court had on May 25 dismissed the application of the Federal and State governments to strike out the "Borneonisation" suit ruling, among others, that the plaintiffs have the right and the locus standi to come to court for the court to decide whether the government has failed to implement the undertakings and assurances contained in the Malaysia Agreement of 1963.
Sabah wants organic food. She wants her citizens live healthier
ReplyDeleteHow's the hearing thus far?
DeletePeople, watch The Cove Movie. The Hard Truths of Mercury Poisoning. Apply or morph it into Sabah Situation. Google it
ReplyDeleteCan you briefly give the synopsis about the movie?
DeleteWell nice suggestion though. But I haven't watch it.
Deletethe federal gov will win unless BN lose in PRU13.
ReplyDeleteBN still can win in Sabah.
DeleteWin or lose we do not want to adopt your crap
DeleteThat is the only two probability.win or lose.
Deletein 13GE, BN will win..
DeleteWell anything can happen. We cant predict but we can work harder to achieve it.
Deletethe borneonisation process in Sabah still going on.
DeleteI wonder what it turn out be.
DeleteThe case of two former civil servants suing the Federal and Sabah governments for allegedly failing to implement the Borneonisation of the public service in Sabah as promised in the Malaysia Agreement 1963 and the Inter-Government Committee Report will go for a full trial in October.
ReplyDeleteWe shall wait till October to follow the Borneonisation suit.
Can't wait to know the final result. The potential for these former civil servants to win is little.
DeleteThe State and Federal Government should work hard to bring Borneonisation in Sabah.
ReplyDeleteSudah lama borneonisasi ni dituntut tapi sampai sekarang masih belum dipenuhi.
DeleteI hope so too.
Deletesemoga borneonisasi akan dilaksanakan sepenuhnya di Sabah.
DeleteThe Federal government always provide opportunities for locals to helm its departments and agencies in the states, Chief Secretary to the Government Datuk Seri Dr Ali Hamsa said.
ReplyDeleteThen why the unsatisfaction arose by these people? Merely tools for the opposition?
Delete
ReplyDeleteIn Sabah, he said, almost all Federal Departments and agencies, like the Health Department, Customs Department, Immigration Department and the Education Department were headed by locals.
ReplyDelete“There are many more federal departments and agencies which are headed by locals. Hence, the issue of locals being sidelined does not arise,” he told reporters after visiting the Queen Elizabeth 1 Hospital near here, yesterday.
Better show the concrete proof rather than just saying. How many local Sabahans are holding the big posts? Who are they?

ReplyDeleteAli was responding to demands made by the opposition in Sabah for more civil servants from Sabah to be appointed to head Federal Departments and agencies in the state in tandem with the concept of “Borneonisation” that was agreed to during the formation of Malaysia.
Tentu ada sebab mengapa mereka bawa kes ini ke mahkamah. Tunggu dan lihat hasilnya.
