Sabah RCI member sues two activists for defamation


KOTA KINABALU - A member of the Royal Commission of Inquiry into Sabah's illegal immigrants has filed a RM50mil suit against two local activists for alleged defamation.

Tan Sri Herman Luping, who is a former Deputy Chief Minister and state Attorney-General, filed the suit against Sabah Bersih coordinator Andrew Ambrose Mudi and environmental activist S.M. Muthu over their statements on his appointment as a commission member.

Luping, who submitted the suit via e-filing on Monday through his counsel Marcel Jude, is seeking a court order to restrain both men from making further defamatory remarks as well as to remove an article on him from the news website www.freemalaysiatoday.com.

In his statement of claim, he said Mudi had made defamatory statements against him in the article entitled “Luping's RCI Appointment Comes Under Fire”, which was published by the website on Aug 13 this year.

He claimed that the statements were calculated to make negative and false inferences about him, including that he was untrustworthy, unfit to be in the commission, dishonest and “a criminal”.

Mudi, he further alleged, had also made the statements via Facebook on Aug 12 and on Twitter that he “could not be trusted and (was) a corrupt politician”.

He said Muthu had also posted further false, malicious and abusive statements about him on Facebook.

Luping is seeking punitive damages, statutory interest and other relief deemed fit by the court.

  3. A Royal Commission of Inquiry (RCI) probing Sabah's longstanding immigrant problem has begun work with the appointment of an investigating officer.

    Commission Secretary Datuk Saripuddin Kasim said the officer began his duties on Monday.

  4. “The officer will be responsible for investigating any matter relating to the commission's terms of reference,” Saripuddin said in a statement here yesterday.

    Prime Minister Datuk Seri Najib Tun Razak had announced on Aug 11 the setting up of the five-member commission.

    Other members are former Universiti Malaysia Sabah vice-chancellor Datuk Dr Kamaruzaman Ampon, former Sabah Attorney-General Tan Sri Herman Luping, ex-Kuala Lumpur police chief Datuk Henry Chin, who is now Malaysian Crime Prevention Foundation deputy chairman, and former State Secretary Datuk K.Y. Mustafa.

  9. Suruhanjaya siasatan Di Raja (RCI) untuk pendatang haram di Sabah diberi masa enam bulan untuk menyiasat dakwaan bahawa pendatang haram diberi kad pengenalan bagi membolehkan mereka mengundi dalam pilihan raya di negeri tersebut.

  10. Perdana Menteri Datuk Seri Najib Razak mengumumkan lapan perkara terma RCi tersebut dan mengatakan ianya telah mendapat persetujuan Yang di-Pertuan Agong.
