Judiciary review on 'Save Kukusan Forest/Trig Hill Reserve"

KOTA KINABALU - Sabah Environment Protection Association (SEPA) has called on the State Authorities and Hap Seng Building Material Sdn Bhd (HSBMSB) to stop blasting our Kukusan Forest / Trig Hill Reserved for the past 6 months or more through press release, police reports and direct engagement but failed to stop the on-going destruction of our iconic Kukusan Forest / Trig Hill Reserved. Not to say our valuable resource (quality stone) being exported by foreign own listed company at an alarming rate.

Hap Seng Building Material Sdn Bhd declared the company had fulfilled all legal requirement under the state laws and were issued with various licences and authorization letters to blast our protected hill and pit mining our stones on the protected areas leaving a potential toxic lake in the future.

In our engagement with them (HSBMSB) they advise us to take our case to state authorities if we thought they had done anything inappropriate as they have deem compliance with the law with licences and authorization letters, issues by various state department.

Therefore, SEPA has taken HSBMSB advice and now in court to file our case for judicial review. Coming to court for judicial review will be our prime action to protect our environment, forest and resources from being destroy and depleted.

  2. The quarrying condition includes an endowment of RM2m from the licensee to the Forestry Department under its " Forest Conservation Fund " to recreate new forest elsewhere on the basis of a " no net loss" policy

HapSeng which has obtained rights to continue mining for stone aggregates in the area in mid-1960s from other quarry operatiors, also reiterated it made sure its operations have the necessary approval from the authorities, these include conditions imposed by EIA and a "Whole of Life Plan for Bukit Kukusan" by the State Government

  6. Ketua Eksekutif Bahagian Kuari dan Bahan Bangunan Ron Delaney menyampaikan cek berkenaan kepada Pengarah Jabatan Perhutanan Sabah Datuk Sam Mannan selepas satu majlis menandatangani perjanjian tambahan bagi aktiviti kuari dan pemuliharaan hutan.

  7. sumbangan kepada Tabung Amanah Pemuliharaan Hutan itu bertujuan membiayai pelbagai program dan aktiviti pemuliharaan hutan oleh Jabatan Perhutanan Sabah.

  9. Sam Mannan berkata Hap Seng telah beroperasi di kuari Bukit Kukusan sejak Julai 1980. Kuari itu terletak di kawasan hutan antara Kampung Kukusan dan Kampung Kukusan Baharu.

  10. Mengenai pemeteraian perjanjian lanjutan itu, beliau berkata ia bertujuan memastikan pengeluaran produk kuari secara berterusan.

    1. Perjanjian itu antara lain membolehkan Hap Seng hak untuk menduduki Hutan Simpan Kukusan bagi tempoh 15 tahun lagi.

  11. Menteri Pelancongan, Kebudayaan dan Alam Sekitar Sabah Datuk Masidi Manjun meminta laporan terperinci mengenai status tanah, yang didakwa sebagai sebuah rizab hutan kelas pertama di Sabah, berikutan aduan berhubung aktiviti kuari oleh sebuah syarikat senaraian awam di kawasan itu.

  12. Beliau berkata laporan itu perlu untuk mengenal pasti kesahan aktiviti kuari yang didakwa dijalankan dalam lingkungan rizab hutan kelas pertama.
