Kota Kinabalu: Any signboard erected without permit and approval should be taken down without having to be issued a notice.
The action can be immediate and the cost shall be charged to the erector.
"Ignoring the instruction to take down may end oneself in court.
The particular section of the law is stipulated in the Advertisement By-law 1983, Sections 3 and 38," said Sabah DAP Vice Chairman, Edward Ewol Mujie.
Edward, a former Kota Kinabalu Municipal Council Secretary, said in the case of the SAPP signboard, City Hall had the right to remove it without serving any notice and that the 14 days notice demanded by SAPP does not apply.
He was commenting on the commotion over a signboard at the Sabah Progressive Party (SAPP) headquarters in Bornion Centre, Luyang, on Monday, that saw a stand-off between City Hall officers and SAPP President Datuk Yong Teck Lee. Yong and SAPP officials had prevented the yellow signboard - put up in conjunction with Saturday's launch of SAPP's "Sabahtv.net" (online TV) and which had the words "Bersih, Berani dan Benar" - from being taken down by City Hall's enforcement unit.
Edward said many people felt that having held the Chief Minister, Local Government and Finance Minister posts as well as being a lawyer, Yong should know that a signboard cannot be erected without proper approval and permit from the authorities.
"In this case, he totally abused the law and took the matter into his own hands. The worst part is that he continued to challenge the power of the authorities," Edward said.
A Fire and Rescue department skylift vehicle was also deployed to take down the illegal signboard, but was stopped by Yong himself.
"This created a traffic jam in Bornion Centre and caused much inconvenience to the public," he said, in a statement, Tuesday.
"We need law abiding citizens who follow the rules and regulations, and not those who challenge the laws," he said.
He said the normal procedure for erecting any signboard is for the erector to submit to the various authorities concerned the application prior to the installation.
"The approval shall come from Dewan Bahasa dan Pustaka approving the wordings, City Hall engineers to certify the safety and its licensing department to verify the charges on advertisement.
"The Public Works Department, Fire Department and police would also have to check on the suitability of the location to avoid any potential danger."
In the past, he said, signboards had been blown by strong wing and fallen on cars and people.
He is just acting like he is the Mayor...or just simply a tool for them. These are cheapskate politicians over a cans of beer.

bukankah di semenanjung itu DAP dan PKR selalu challenge the law, banyak case dalam mahkamah, di dalam parliament walk out sekumpulan kerana tidak ikut cakap Speaker. Di Sabah DAP ini penakut pula. ikut law konon...ha ha.
