KOTA KINABALU - A senior police officer who claimed trial to one count of sodomising and three counts of raping a minor will be tried in the Sessions Court here from December 9 to 13.
Court Judge Ismail Brahim released Deputy Superintendent (DSP) Rohaizat Abd Ani on bail of RM40,000 with RM20,000 deposited, pending disposal of his case.
Ismail meanwhile fixed August 21 for Rohaizat’s case management.
Rohaizat, who is defended by counsel Ram Singh, was charged under Section 377B of the Penal Code with sodomising a 13-year-old girl in a hotel room here on February 1.
He was charged under Section 376(1) of the Penal Code with raping the girl at the same hotel on February 1 and 2, and in May.
Each of the four charges carries a maximum custodial sentence of 20 years and also whipping upon conviction.
Senior Federal Counsel Jamil Aripin, who is assisted by Deputy Public Prosecutor Raja Zaizul Faridah Raja Zaharuddin, proposed for bail at RM15,000 for each charge with one local surety, but this was objected to by Ram.
Ram proposed for bail at RM5,000 for each charge with the accused’s wife as the surety, on the grounds that the accused is still serving as a police officer.
However, the court released the accused on bail of RM10,000 for each charge with RM5,000 deposited in one local surety.
