BN govt dragging its feet on NCR problems

PENAMPANG: Sabah Progressive Party (SAPP) said the present State Barisan Nasional (BN) Government is purposely delaying to solve problems over land matters which has Native Customary Rights (NCR).

SAPP President Datuk Seri Panglima Yong Teck Lee said such tactics were used because the general election is about to be held soon.

"Present Sabah BN Government is dilly dallying it," he said here.

He said Chief Minister Datuk Seri Musa Aman statement that the government is inviting Sabah BN component parties' leaders and expert to give views on NCR is clearly a tactic to delay it.

He said the present State Cabinet already have seven lawyers who could give views at any time to Musa so that the Chief Minister do not have to make excuses with statements.

Yong said the seven are the three Deputy Chief Ministers, Tan Sri Joseph Pairin Kitingan, Datuk Seri Panglima Yahya Hussein and Datuk Dr. Yee Moh Chai, former Deputy Chief Minisater Datuk Raymond Tan, Tourism and Environment Minister Datuk Masidi Manjun, Welfare and Community Development MInister Datuk Azizah Mohd Dun and Industrial Development Minister Datuk Ewon Ebin.

According to Yong, the present State BN Government has yet to make a stand over the statement made by State Attorney General that there were no more NCR lands after 1930.

He said NCR lands are those lands occupied by natives for several years.

"However, over the last five years many villages in the interior were destroyed and the lands were given to private companies mostly from Kuala Lumpur. Houses were burnt down, crops and cemetery were destroyed to delete evidences," he said.

He said under the Forest Management Unit (FMU) villages occupied by natives within it must be preserved and be developed with facilities like electricity, water, roads, clinics, schools and many others.
Yong said Section 22, 23 and 24 of the of the unit clearly stated that the companies given SFMLA licenses under the FMU must provide such facilities.

He said its is the duty of the government of the day to ensure that the companies comply with the terms and conditions.

  1. WHY WOULD UMNO BOTHER TO SOLVE SABAH NCR "PROBLEM"?

The NCR land problem is a creature of UMNO BN's creation for self-interested money making schemes thinly disguised as "development".

UMNO will not have any serious intent to solve this problem since this would challenge its own theft of over 300,000 acres of choice Sabah land!

What about the rights of the people in Labuan who got "federalised"???

Sabahans wake up and stop UMNO colonization before you lose everything!

  22. Chief Minister Datuk Seri Musa Aman said he will invite Sabah Barisan Nasional (BN) component leaders and experts to give their views on Sabah Native Customary Rights (NCR) land issues soon. He said the State Cabinet discussed the issue at length during its meeting at Wisma Innoprise. "We will also have a full briefing and discussion with the directors of Land and Survey Department and Forestry Department," said the Chief Minister.

    1. He said the meeting to obtain the views of the BN component leaders was a follow-up on his earlier promise. The NCR land issue became a hot topic among Sabah BN coalition partners after State Attorney-General Datuk Roderic Fernandez came out with a statement saying that no fresh NCR land can be created after 1931.

      Delete
    2. Nevertheless, his statement did not go down well with certain quarters that saw protem head of the Pusat Sumber Adat and Mediasi Kaum Anak Negeri (Pusaka, Sabah), Martin Idang, issue the first rebuttal.

    3. Idang said the question of whether Native Customary Rights are recognised by Malaysian law is contained within the tenets of the law. "The Federal Court, in fact, has recognised that NCR pre-exists legislation."As a matter of law, NCR can only be extinguished through a specific provision contained within the legislation," he said.

    4. Following this, Upko President, Tan Sri Bernard Dompok described Fernandez's statement as a "destructive statement". Unlike in Sarawak, he said there was no cut-off point with regard to NCR land in the context of Sabah.

    5. In the Sarawak Land Code, new NCR rights could not be established after 1958 (Section 5, Sarawak Land Code).

    6. PBS Deputy President, Datuk Dr Maximus Ongkili said although it was for the courts to decide if it comes up, based on previous decisions, it was consistent that customary rights can be established within the land ordinance.
"Otherwise all decisions of the court would have been wrong," he said.

    7. President of Parti Bersatu Rakyat Sabah (PBRS), Tan Sri Joseph Kurup, said the A-G must be made aware that rights over customary land tenure are the basic tenets of native life being the sons of the soil of this land.

      Delete
    8. He said Fernandez as the State A-G should be more careful especially when his advice has the effect of taking away the basic rights of the natives.
