Sulu Sultanate to ‘fine’ Malaysia for illegally developing Sabah

KUALA LUMPUR - Lawyers for the Sulu Sultanate are drawing up details of a US$25 billion (RM78 billion) suit against Malaysia for allegedly usurping authority and illegally developing Sabah’s natural resources, The Manila Times reported today.

The English daily said the sultanate plans to bring the matter before the International Court of Justice (ICJ) as its response to Malaysia’s decision to file terrorism charges against eight of its followers in Sabah on Wednesday.

The US$25 billion “fine” is meant to represent Malaysia’s payment for “exploiting the natural wealth of Sabah”, which the Kiram clan continues to insist belongs to the Sulu Sultanate.

Sultanate spokesman Abraham Idjirani reportedly said yesterday that the charges in Malaysia were “illegal” and should not have been exacted against the eight individuals who were believed to be involved in the Sulu siege on the north Borneo territory.

“Walang basehan ang [There is no basis for] Malaysia to file charges against those eight Filipinos dahil hindi sila ang nagmamay-ari ng [because it did not own] Sabah,” Idjirani was quoted as telling a press conference in Taguig City, the Philippines.

“We condemn the terroristic act of Malaysia dahil sila ay hindi nagmamay-ari ng [because they don’t own] Sabah. They are just occupant so they have no right to file charges against Filipinos,” he added.

Idjirani also cast doubts over the identities of the eight who were charged, demanding the Malaysian authorities reveal where they had been apprehended.

He suggested that the eight may be mere civilians who were not part of the sultanate’s “royal army” which landed in Sabah on February 9.

Sulu “crown prince” Agbimuddin Kiram, the brother of “Sultan” Jamalul Kiram III, led a group of 235 armed militants to Sabah’s Lahad Datu on February 9 to stake the sultanate’s claim over the north Borneo state.

The intrusion has so far resulted in the deaths of 63 Sulu rebels, according to figures from Malaysian security forces, as well as 10 Malaysians, including eight policemen and two soldiers.

Malaysia launched Ops Daulat on March 5 to flush out the armed rebels after weeks of negotiation failed to result in a peaceful resolution.

Security forces are still conducting mopping-up operations today although intelligence officials believe that Agbimuddin has already fled Sabah to the Philippines.

Manila has said it will not abandon the sultanate’s claim over Sabah, even as Malaysian authorities insist the claim is no longer valid due to the inclusion of the state in the 1963 Malaysia agreement.

  2. NNOT "ILLEGALLY DEVELOPING" BUT "ILLEGALLY STRIPPING SABAH WEALTH"- WHERE GOT DEVELOPMENT?

    The lawyers need to redraft their Statement of Claim as above.

    The claim for US$25 billion is chicken feed compared to the trillions (in oil money) UMNO (and foreign companies) has been stealing from us. Is that what the Suluks are actually gunning for with their Sabah claim?

    Suggest that damages be set at US$1000 Trillion for pains and sufferings caused to the Borneo people for 50 years of colonial oppression in Malaysia and that the money be paid to Sabah and Sarawak.

    Maybe sue Malaya in the Malayan Federal Court since the Sultan and 800,000 Suluks are Malaysian citizens. They are entitled to their Malayan Constitutional rights (masquerading as Malaysian Constitution).

    The Suluks are correct in saying that Malaya "does not own Sabah" (nor Sarawak) but neither do the Suluks have a valid claim on Sabah. (1985 Madrid protocol on conquered territories).

    Sabah (and Sarawak) belong to the people living in here and in possession of the land before the 1963 Malayan invasion and Malayan sponsored invasion of 3.5 million foreign illegals.

    Sabah and Sarawak people should join in this legal action and sue the UMNO government for the following claims:

    (1) That Malaya has illegally squatted on and or occupied and pillaged these 2 countries and oppressed the people for 50 years;

    (2) That Malaya pays back rental to the 2 colonies plus compensation for pain and sufferings;

    (3) that UMNO de-colonises the 2 colonies, return all stolen wealth, compensation for damage to environment and interest from stolen wealth and

    (4) that the Malayan occupation army evacuates from both countries.

    Malaya and Sulus are fighting over the foreign soil of Sabah rightfully belonging to the Sabah people.

    "That Brunei should claim back Sabah and Sarawak and form an independent federation of Borneo States"

    The original Brunei Empire covered Sabah and Sarawak.

    In 1962 the Brunei People's Party won the first and last Legislative Council general elections in Brunei and it put forward 3 resolutions:

    i) Reject the idea of joining Malaysia
    ii) Restore Brunei sovereignty over Sarawak and Sabah
    iii) British grant of independence to the Borneo federation (North Kalimantan) by 1963.

    These proposal makes more sense as the 3 territories were historically one entity.

    Do all Sabahans and Sarawakians ever wonder why Brunei did not buy UMNO's ponzi scheme?

    From the beginning UMNO wanted to be big brother and (1) take control of Brunei's oil wealth and (2) refused to give Brunei "equal partners" status by refusing to recognise that the Sultan has the same ranking as the Malayan sultans.

    So Brunei was not treated equally. That was the 2 main reasons.

    Singapore also left when it found out it was not an "equal partner" (promised by Tunku A Rahman ex-Malayan PM with fingers crossed behind his back).

    Why are we still deluded by the fake "independence in Malaysia"?

    It has turned out to be a ponzi scheme with a 50 year track record of totally failed promises. Malaya might as well have promptly filed the 18/20 Points agreement in a dustbin.

    Do not Brunei and Singapore's examples tell us that being free and independent outside Malaysia has been such a blessing for them. So lucky.

    We can all go back to bearing the Malayan colonial yoke and sleep without supper for 50 more years.

    OR we can throw off this foreign apartheid yoke forever and become masters of our own destiny!

    Malaya needs Sabah and Sarawak more than they need Malaya.

    No Sabah No Sarawak No Malingsia!

Walaupun pernah diperintah Kesultanan Sulu, Sabah atau sebelum ini dikenali sebagai Borneo Utara telah diletakkan di bawah pentadbiran British North Borneo Company pada 1878 dan kemudiannya Empayar British, sebelum diberikan kemerdekaan dan membentuk Persekutuan Malaysia bersama-sama Sarawak dan Tanah Melayu.

  7. Memberikan contoh kes Pulau Batu Puteh, katanya Malaysia hilang hak ke atas pulau itu kepada Singapura kerana walaupun merupakan pemegang hak, ia (Malaysia)tidak pernah mentadbir atau hadir secara fizikal di atas pulau itu.

  8. Dilaporkan akhbar Filipina "Philippine Star" beberapa hari lepas melaporkan kerajaan Filipina tidak pernah melepaskan Sabah dan telah melantik sepasukan peguam untuk mengkaji tuntutannya ke atas Sabah.

  9. Ranjit Singh, yang pakar dalam sejarah Sabah dan Sarawak, juga berkata isu itu tidak boleh dirundingi kerana kehendak penduduk Sabah perlu dihormati yang menerusi Suruhanjaya Cobbold pada 1962 telah memilih untuk membentuk Malaysia bersama-sama Sarawak dan Tanah Melayu.

    Menyedari jumlah lanun Sulu yang semakin berkurangan dibantai pasukan keselamatan Malaysia, Jamalul Kiram III yang masih bercakap besar bagi menunjukkan kononnya dia seorang sultan yang berdaulat telah 'menarik balik gencatan senjata' sebelah pihak yang diumumkannya beberapa hari lepas. Sebaliknya berita yang mengatakan 10,000 lanun Sulu yang sudah berada di Sabah semenjak 7 bulan lalu, telah dijadikan sebagai modal untuk menggertak kerajaan serta rakyat Malaysia.

    Sebuah kapal perang Amerika Syarikat yang tersangkut di terumbu di Laut Sulu, telah dimusnahkan beberapa hari lepas. Beberapa persoalan berhubung pemilikan persenjataan yang lebih baik di kalangan lanun-lanun Sulu itu, jelas sekali merujuk kepada pendalangan beberapa pihak yang membiayai dari segi kewangan mahupun logistik kepada lanun-lanun Sulu tersebut.

    Dari segi sejarah, keluarga Kiram adalah pembunuh Bangsamoro yang paling utama apabila datuk kepada Jamalul Kiram III membenarkan tentera Amerika Syarikat membunuh lebih 40,000 orang Sulu termasuklah wanita dan kanak-kanak sewaktu Amerika Syarikat menjadi penjajah Filipina.

    Sebaliknya pasukan keselamatan Malaysia akan melakukan penggempuran hebat seandainya lanun-lanun Sulu itu cuba mengganggu gugat mana-mana wilayah negara ini. Malaysia sudah memberikan peluang kepada lanun-lanun Sulu itu untuk menyerah dan meletakkan senjata serta berundur keluar dari Sabah dengan aman tetapi mereka pula menganggap, tolak ansur yang diberikan oleh Kerajaan Malaysia sebagai satu kelemahan. Juga ada dinyatakan yang rakyat Sabah telah MEMILIH untuk menyertai Malaysia melalui Suruhanjaya Cobbald diawal 60an dan ini seiring dengan pendirian Mahkamah Antarabangsa yang menetapkan - Rakyat yang menetapkan nasib tanah / wilayah dan bukannya tanah / wilayah yang menetapkan nasib rakyat.
