Another man was charged at the High Court in Tawau today with being a member of a terrorist group involved in the intrusion incident in Lahad Datu last February.
Habil Suhaili, however, pleaded not guilty to the offence alleged to have been committed from Feb 9 to March 4, 2013, at Jalan Kastam Lama in Lahad Datu.
Habil, who is represented by a group of lawyers led by James Tsai, is the 30th individual to have been charged with various offences related to the Lahad Datu intrusion incident so far.
The charge under Section 130KA of the Penal Code, which provides for life imprisonment and a fine upon conviction, was read out to him before High Court Judge P Ravinthran in a special session at the Tawau Prison.
Attorney-general Abdul Gani Patail prosecuted.
When met outside the prison, Abdul Gani said the court had agreed to transfer the case to Kota Kinabalu High Court and that it would be heard with other intrusion-related cases there.
The court also set July 15 for case management.
On June 27, 29 individuals who were charged with various offences related to the intrusion incident pleaded not guilty at the Kota Kinabalu High Court and they would be tried simultaneously.
Meanwhile, James Tsai said the lawyers, who were appointed by the Philippine government, were representing 22 of the accused.

Chief Minister Datuk Seri Musa Aman said the resolved Lahad Datu intrusion incident has no connection with the "Sulu Sultanate" claim on Sabah, but merely an attempt by terrorists to create a security problem in the country, especially in Sabah.
ReplyDeleteHe said there were an estimated 200 terrorists who claimed themselves to be members of the "Royal Sulu Sultanate Army" that intruded Lahad Datu on Feb. 9 this year.
DeleteDatu Agbi Muddin Datu Kiram and Jamalullail Kiram were the masterminds in this intrusion, he said, adding there were also Malaysian citizens involved and they are presently being investigated by police. He said the terrorists involved refused to retreat from the intruded area and because of this the country's security forces launched an offensive on the group on March 5.
ReplyDeleteThe firefights claimed the lives of 80 people, including eight policemen and two army personnel, as well as forced villagers in the affected area to leave their homes. Musa was responding to Klias Assemblyman Datuk Haji Lajim Haji Ukin and five other assemblymen during the Question and Answer (Q&A) session at the State Legislative Assembly sitting, Tuesday.
ReplyDeleteLajim, who is also the assembly opposition leader, wanted to know if it was true the Sultan of Sulu III demanded for his rights on Sabah and who are those suspected to be the mastermind(s).
DeleteMusa, who is Sungai Sibuga Assemblyman, said Sabah is an independent and sovereign state in Malaysia, adding a book by the Federal Attorney General titled "Putting to Rest the Claim to Sabah by Self-proclaimed Sultanate of Sulu" also stated Sabah's status as legitimately being part of Malaysia based on two main points.
ReplyDeleteFirstly, on valid and legitimate instruments where the Sultan of Sulu previously had completely and irrevocably ceded this region known now as Sabah as well as all its claims and rights other than the cession money. Secondly, all the claims or rights of the Sultan of Sulu on Sabah region, although it was valid or existed in 1962/1963, had become void by the self determination of the people of Sabah through the referendum by the Cobbold Commission from August to September 1963.
ReplyDeleteThe United Nations (UN) through its Secretary-General had also implemented another referendum where the people of Sabah had voiced their intention voluntarily to achieve independence from the British and, thus, agreed together with the Malay Federation, Sarawak and Singapore to form Malaysia.
ReplyDeleteMalaysia government does not breach the agreement.
DeleteThe Chief Minister said based on this the Government will not let even an inch of Malaysian soil be claimed by the so-called Sultan of Sulu III or any other party. "So it is not true that this 'Sultan of Sulu III' has the rights to claim Sabah."
ReplyDeleteThe government has since declared the East Coast as a Special Security Area and placed the security team to control the area and to safeguard security in that region.
DeleteHe said this involved the setting up of the Special Security Area in Sabah or Esscom (Eastern Sabah Security Command) as announced by the Prime Minister in March 2013, following the intrusion incident.
ReplyDeleteAmong the main responsibilities entrusted to Esscom is to strengthen the security control along the East Coast coastal area apart from increasing the intelligence capability in the said area.
He said 10 districts have been gazetted as Esszone (Eastern Sabah Security Zone) comprising Kudat, Kota Marudu, Pitas, Beluran, Sandakan, Kinabatangan, Lahad Datu, Kunak, Semporna and Tawau.
The PM, himself, also officiated at the launching of Esscom headquarters at the Marine Police Base in Lahad Datu on April 13, he said, adding Esscom is presently moving on the right track and is capable of moving along with the set vision, mission and objective. He said Esscom vision is to be the pioneering agency to the security and prosperity of the people in the East Coast of Sabah by 2017, while its mission is to maintain and strengthen the security activities in the East Coast of Sabah from any enemy threat.
ReplyDeleteThis is being implemented through strategic collaboration between the State Government and Federal agencies in assisting in accelerating the State's development for the sake of the people. Musa also detailed the Esscom objectives and core strategies, and said it has already implemented various activities since its establishment.
ReplyDeleteAmong them is holding meetings on the barter trade issue, on the designated maritime route, on handling the resettlement issue of the water village people in Esszone, as well as carrying out monitoring on the level of security and public order during the 13th General Election by placing two Esscom senior officers each in all 10 Esszone districts.
ReplyDeleteAlso coordinating the security issue during the Regatta Lepa-Lepa in Semporna, conducting evaluation visit to the security posts around Semporna, Tawau and Lahad Datu and holding meeting with the community heads of Tanjung Labian, Tanjung Batu, Sinakut, Sungai Nyamuk, Lok Buani, Sungai Bilis and Tanduo.
Apart from that, Esscom also strives to increase the number of security manpower and assets in preparation for any future threat.
ReplyDeleteAll the security and enforcement agencies will strive to ensure the incidences in Tanduo, Lahad Datu, will not recur, he added.
DeleteMusa said the Government has also taken apt measures to create suitable infrastructure for placing the assets of Esscom security forces, adding five battalions of army and police (General Operations Force) will be placed in East Coast area and the government is still studying on the suitable location for all these battalions.
ReplyDeleteHe said the cabins used specifically for the Esscom headquarters and several police stations are also just temporary.
DeleteMusa said the government, which is concerned over the welfare of the villagers affected by the intrusion incident, has prepared two proposals for the resettlement of affected villages in Tanjung Batu and Tanjung Labian.
ReplyDeleteHe said for Tanjung Batu villagers a settlement is now in the process of development on a proposed 6.1-hectare reserve land of the village, involving 25 new homes.
Ensure the project a success so that the people can proceed their live as usual.
DeleteFour of the houses were built on titled lands while 21 others on State land, he said, adding the house construction project has already started and expected to meet full completion in August this year.
ReplyDeleteFor the Tanjung Labian settlement, he said it would be developed on Lahad Datu District Settlement Reserve Land at Kampung Tenagian, involving 52 new houses.
He said the right of way to enter and start construction has already been obtained from the Land and Survey Department, but the process to determine the boundary is yet to be decided by the District Surveyor.
ReplyDeleteAt the same time, the 106 homes damaged during the incident had already been repaired fully by the Rural and Regional Development Ministry through Giat Mara and Felcra Sdn Bhd.
Musa said 31 people have been charged and brought to the High Court following the intrusion incident and investigations are currently being carried to identify the cause and mastermind(s) of the intrusion.
ReplyDeleteAssuring the security in Sabah especially in the Esscom districts is under control, he said until now there has not been any other intrusion incident reported.
"Nevertheless, Esscom would continue to monitor the security situation especially in the East Coast of Sabah," he said, adding the security agencies involved like army, police and Malaysian Maritime Enforcement Agency (MMEA) are always assisting each other and will act accordingly if there is any new threat detected.

DeleteExclusive: Mystery shrouds whereabouts of Raja Muda who led Lahad Datu armed intrusion
ReplyDeleteLAHAD DATU: The whereabouts of the 72-year-old Raja Muda Azzimudie Kiram who led the armed Sulu intrusion into Kg Tanduo remain a mystery.
Azzimudie or Agbimuddin, the younger brother of self-styled Sulu Sultan Jamalul Kiram, disappeared without a trace after he "fled'' Lahad Datu on March 11 as Malaysian security forces recaptured Kampung Tanduo, Sabah in a massive offensive.
Security forces are certain that he fled to an island at Tawi Tawi province in the southern Philippines close to Sabah but family members insist he is in Lahad Datu waging a guerrilla war.
DeleteTawi Tawi officials believe that he is with a network of sympathisers and has kept a low profile to avoid being detained by Manila which has ordered his arrest for waging a war with a foreign country.
It has also been speculated that Azzimudie, a former assistant district officer of Kudat, Sabah in the early 1970s, was killed by his bodyguard in Kampung Tanduo and buried in an unmarked grave sometime after the Malaysian air and ground offensive to flush out the Sulu gunmen began on March 5.
DeleteIn an interview with The Star, Sabah Police Commissioner Datuk Hamza Taib said the police believed that Azzimudie was still alive and was hiding in some islands in his home country.
Delete"Azzimudie is definitely not in Lahad Datu, they (Sulu spokesman Abraham Idjirani) can fly kites if they want to keep insisting that Azzimudie is in Lahad Datu, hiding and moving from one place to another,'' he said when asked about the persistent claims by the Sulu group spokesman Idjirani in the Philippines.
However, Hamza did not rule out the possibility that Aghimuddin was still planning to wage a guerrilla war against Sabah.
DeleteHe suspected that Azzimudie's family members were insisting that the Raja Muda was still in Sabah because he (Azzimudie) had made many promises (before the intrusion) to Sulu gunmen, who were now dead or facing criminal charges in Malaysia.
"So to prevent him from being killed (in Philippines), they have to say that Azzimudie is in Lahad Datu and still fighting,'' he said, adding there had been no clashes between Sulu gunmen and security forces in Sabah since the intrusion was put down by early April.
DeleteKampung Tanduo has since been closed to the public, with a security base set up at the seaside village and the state government working to relocate more than 20 local families in the area.
In a telephone interview with The Star in Manila, Idjirani, who is the brother-in-law of Azzimudie, insisted that Azzimudie was still ``somewhere in Lahad Datu'' waging a guerrilla war against Sabah.
DeleteIdjirani, however, did not know the exact location of his brother-in-law.
“I know that he is hiding in a forest and has adopted guerrilla tactics and is moving from one place to another around Kampung Tanduo,” he said.
DeleteIdjirani claimed that he frequently spoke to Azzimudie.
"In fact, I spoke to him two days ago. He called us and told us that there was an encounter between the Royal Sulu Army and the Malaysian security forces in Mile 9 in Lahad Datu on June 16 and Kampung Labian on June 18,’’ he said.
The spokesman believed that the Malaysian security forces were unable to locate Azzimudie as he was no longer using his handphone.
Delete"He is no longer is using his cell phone, as in March (during the aerial bombings), he realised that using his cell phone would lead to detection,’’ he said.
Delete"The Raja Muda and his followers are seasoned fighters and even though the Malaysian forces have more firepower they could not defeat them," he said, in claiming that Malaysian forces were cautious in confronting them.
A total of 35 followers of Azzimudie were arrested by Philippines authorities after they returned from Lahad Datu and recently, the Philippines National Bureau of Investigations recommended various criminal charges - including waging war with a foreign country - be brought against the Raja Muda and his followers who entered Kampung Tanduo between Feb 9 and 12.
DeleteA total of 73 intruders were killed (59 bodies have been recovered) in the nearly eight-week armed showdown with Malaysian security forces.
DeleteMalaysian police have arrested 184 people and charged 31 with various criminal offences, including waging war against the Agong. Their cases are ongoing in court.
CHARGE MAHATHIR FOR STARTING ALL THIS SANDIWARA
