Anwar acquitted

KUALA LUMPUR: Opposition Leader Anwar Ibrahim was today discharged and acquitted of a sodomy charge by the High Court here.

High Court judge Mohamad Zabidin Mohd Diah said that he was not 100 per cent sure that the DNA evidence was not compromised.

“After going through defence and evidence in full, the court could not be 100 per cent certain that the DNA evidence was not compromised.

“It is not safe to rely on DNA evidence. There can be no corroboration.

“There is no other evidence except the testimony of SP1 (Saiful) of penetration… the court is reluctant to convict based on evidence of Saiful.

“It is not safe to conclude…the court is reluctant to convict the accused based on such evidence,” said the judge.

“As such the accused is acquitted and discharged,” he said.

In an immediate reaction, Anwar said he was surpised by the court’s decision. “Justice has been served and I have been vindicated,” he said.

The decision brought joy to those in the court, with many loudly cheering and walking over to Anwar to congratulate him.

Three years ago, Anwar was charged with having sodomised Mohd Saiful Bukhari Azlan, his former aide, then 22.

Anwar pleaded not guilty to the offence, allegedly committed at a Desa Damansara condominium unit in Bukit Damansara on June 26, 2008.

The PKR de facto leader is facing a maximum of 20 years in prison and whipping, if found guilty under Section 377B of the Penal Code.
